{"data":{"id":"us-ky/krs-335b.020","jurisdiction":"us-ky","citation":"KRS 335B.020","heading":"Disqualification from public employment or occupational license because","body":"of prior criminal conviction prohibited -- Items submitted by applicant --\nRebuttable presumption for person who obtains certificate of employability\nunder KRS 196.281.\n(1) A person shall not be disqualified from public employment or from pursuing,\npracticing, or engaging in any occupation for which a license is required solely\nbecause of a:\n(a) Prior conviction of a crime, unless the crime for which the person was\nconvicted directly relates to the position of employment sought or the\noccupation for which the license is sought; or\n(b) Finding that an applicant lacks good character or fails to meet any other\nsimilar standard where a criminal conviction is the sole basis for the finding.\n(2) In determining if a conviction directly relates to the position of public employment\nsought or the occupation for which the license is sought, the hiring or licensing\nauthority shall consider items submitted by the applicant, which may include:\n(a) The individual's criminal history, including but not limited to:\n1. The nature and seriousness of the crime;\n2. The individual's age when the offense was committed;\n3. The length of time since the offense was committed;\n4. The relationship of the crime to the public employment position sought\nor the occupation for which the license is sought; and\n5. The relationship of the crime to the ability, capacity, and fitness required\nto perform the duties and discharge the responsibi lities of the public\nemployment position or licensed occupation;\n(b) Any bonding requirements for the occupation for which the license is sought;\nand\n(c) Any evidence of rehabilitation submitted by the applicant, including but not\nlimited to evidence relat ed to the person's compliance with any conditions of\ncommunity supervision, parole, or mandatory supervision, the conduct and\nwork activity of the person, treatment undertaken by the person, and\ntestimonials or personal reference statements.\n(3) There shall be a rebuttable presumption for any occupational license that requires\ngood moral character that the person applying for the license is of good moral\ncharacter if, after the criminal conviction, the person obtains a certificate of\nemployability pursuant to KRS 196.281 and the certificate has not been revoked.\nThis rebuttable presumption shall not apply if the conviction would qualify the\nindividual as a registrant as defined in KRS 17.500.","path":["KRS Chapter 335B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57421","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:25Z","sha256":"243211eb0a0e50ccc6b4398882104b85752ac8eaaf321d9deb39110671358e45","source_id":"us-ky","stale":false,"prev":"us-ky/krs-335b.010","next":"us-ky/krs-335b.025"},"notice":"GroundRules: Original legal text.
