{"data":{"id":"us-ky/krs-336.250","jurisdiction":"us-ky","citation":"KRS 336.250","heading":"Violations -- Penalties.","body":"(1) A person shall not knowingly:\n(a) After July 15, 2024, offer or provide professional employer services or use the\nnames professional employer organization, PEO, staff leasing, employee\nleasing, administrative employer, or other title representing professional\nemployer services without firs t becoming registered under KRS 336.230 to\n336.250; or\n(b) Provide false or fraudulent information to the Department of Workers' Claims\nin conjunction with any registration, renewal, or in any report required under\nKRS 336.230 to 336.250.\n(2) Action may be taken by the Department of Workers' Claims against:\n(a) Any person for violation of subsection (1) of this section;\n(b) A professional employer organization or the controlling person of a\nprofessional employer organization upon the conviction of a prof essional\nemployer organization or the controlling person of a professional employer\norganization of a crime that relates to the operation of the professional\nemployer organization or the ability of the registrant or the controlling person\nof the registrant to operate the professional employer organization;\n(c) A professional employer organization or the controlling person of a\nprofessional employer organization for knowingly making a material\nmisrepresentation to the Department of Workers' Claims or any ot her state\nagency; or\n(d) A professional employer organization or the controlling person of a\nprofessional employer organization for a willful violation of KRS 336.230 to\n336.250 or any order or administrative regulation issued by the Department of\nWorkers' Claims under KRS 336.230 to 336.250.\n(3) Upon finding that a professional employer organization or the controlling person of\na professional employer organization has violated any provision of KRS 336.230 to\n336.250, the Department of Workers' Claims may:\n(a) Deny an application for a registration;\n(b) Revoke, restrict, or refuse a registration;\n(c) Impose a civil penalty not to exceed one thousand dollars ($1,000) for each\nviolation;\n(d) Place a registration on probation and subject to conditions specified by the\nDepartment of Workers' Claims; or\n(e) Issue a cease and desist order.","path":["KRS Chapter 336"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52605","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:25Z","sha256":"6c09e05ae07207ccfbc69defe4788ebb5a04263e5b65abeaaf3ce627e410c749","source_id":"us-ky","stale":false,"prev":"us-ky/krs-336.248","next":"us-ky/krs-336.510"},"notice":"GroundRules: Original legal text.
