{"data":{"id":"us-ky/krs-336.990","jurisdiction":"us-ky","citation":"KRS 336.990","heading":"Penalties, civil and criminal -- Remedies -- Damages.","body":"(1) Upon proof that any person employed by the Education and Labor Cabinet as a\nlabor inspector has taken any part in any strike, lockout or similar labor dispute, the\nperson shall forfeit his or her office.\n(2) The following civil penalties shall be imposed, in accordance with the provisions in\nKRS 336.985, for violations of the provisions of this chapter:\n(a) Any person who violates KRS 336.110 or 336.130 shall for each offense be\nassessed a civil penalty of not less than one hundred dollars ($100) nor more\nthan one thousand dollars ($1,000);\n(b) Any corporation, association, organization, or person that violates KRS\n336.190 and 336.200 shall be assessed a civil penalty of not less than one\nhundred dollars ($100) nor more than one thousand dollars ($1,000) for  each\noffense. Each act of violation, and each day during which such an agreement\nremains in effect, shall constitute a separate offense;\n(c) Any employer who violates the provisions of KRS 336.220 shall be assessed a\ncivil penalty of not less than one hun dred dollars ($100) nor more than one\nthousand dollars ($1,000) for each violation; and\n(d) Any labor organization who violates KRS 336.135 shall be assessed a civil\npenalty of not less than one hundred dollars ($100) nor more than one\nthousand dollars ($1,000) for each offense.\n(e) Any public employer or labor organization that violates KRS 161.158,\n164.365, 336.133, 336.134, 336.1341, 336.135, or 336.180 shall be assessed a\ncivil penalty of not less than one hundred dollars ($100) nor more than one\nthousand dollars ($1,000) for each offense.\n(3) Any labor organization, employer, or other person who directly or indirectly\nviolates KRS 336.130(3) shall be guilty of a Class A misdemeanor.\n(4) Any person aggrieved as a result of any violation or threatened vio lation of KRS\n336.130(3) may seek abatement of the violation or threatened violation by\npetitioning a court of competent jurisdiction for injunctive relief and shall be\nentitled to costs and reasonable attorney fees if he or she prevails in the action.\n(5) Any person injured as a result of any violation or threatened violation of KRS\n336.130(3) may recover all damages resulting from the violation or threatened\nviolation and shall be entitled to costs and reasonable attorney fees if he or she\nprevails in the action.","path":["KRS Chapter 336"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53561","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:26Z","sha256":"30c92c328d9b10722b9e601bcc9a797aadae298671eb3f3670bbdab149636daa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-336.985","next":"us-ky/krs-337.010"},"notice":"GroundRules: Original legal text.
