{"data":{"id":"us-ky/krs-337.075","jurisdiction":"us-ky","citation":"KRS 337.075","heading":"Lien on property of employer who  violates provisions of chapter --","body":"Recording of lien.\n(1) A lien may be placed on all property, both real and personal, of an employer\nwho  has been assessed civil penalties by the commissioner for violations of the\nwages  and hours provisions of this chapter, but not before all administrative\nand  judicial appeals have been exhausted. The lien shall be in favor of the\nEducation and Labor Cabinet and shall be an amount totaling the unpaid\nwages  and penalties due, together with interest at a rate of twelve percent\n(12%) per annum from the date the notice of the violation is final, but not before\nall administrative and judicial appeals have been exhausted. The lien shall be\nattached to all property and rights to property owned or subsequently acquired\nby  the employer. The commissioner or the commissioner's designee shall\nrecord the lien as provided in subsection (2) of this section. The lien shall show\nthe date on which the notice of violation was issued, the date of the violation,\nthe  name  and  last known  address of the employer against whom  the\nassessment  was  made, and the amount  of unpaid wages, penalties, and\ninterest. The lien shall be superior to the lien of any mortgage or encumbrance\nthereafter created and shall continue for ten (10) years from the time of the\nrecording, unless sooner released or otherwise discharged.\n(2) The lien shall be filed in any of the following offices in which the employer owns\nproperty or rights to property and any filing fees associated with filing the lien\nshall be pursuant to KRS 64.012:\n(a) The  office of the county clerk of the county in which the defendant\nemployer resides.\n(b) The  office of the county clerk of the county in which the defendant\nemployer has its principal place of business.\n(c) The  office of the county clerk of any county in which the defendant\nemployer has property or an interest in property.","path":["KRS Chapter 337"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52426","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:26Z","sha256":"bfe908d95b5c18157f688834b3fd7742b2fb874a5fd3500c5093abc193366574","source_id":"us-ky","stale":false,"prev":"us-ky/krs-337.070","next":"us-ky/krs-337.100"},"notice":"GroundRules: Original legal text.
