{"data":{"id":"us-ky/krs-337.423","jurisdiction":"us-ky","citation":"KRS 337.423","heading":"Discrimination prohibited.","body":"(1) No  employer shall discriminate between employees in the same establishment\non the basis of sex, by paying wages to any employee in any occupation in this\nstate at a rate less than the rate at which he or she pays any employee of the\nopposite  sex  for comparable  work  on  jobs which  have  comparable\nrequirements relating to skill, effort and responsibility. Differentials which are\npaid pursuant to established seniority systems or merit increase systems,\nwhich do not discriminate on the basis of sex, shall not be included within this\nprohibition. Nothing in KRS  337.420 to 337.433 and 337.990(11) shall apply to\nany employer who is subject to the federal Fair Labor Standards Act of 1938,\nas amended, when that act imposes comparable or greater requirements than\ncontained in KRS  337.420 to 337.433 and 337.990(11) and when the employer\nfiles with the commissioner of the Department of Workplace Standards a\nstatement that the employer is covered by the federal Fair Labor Standards Act\nof 1938, as amended.\n(2) An  employer who is paying a wage differential in violation of KRS  337.420 to\n337.433 and 337.990(11) shall not, in order to comply with it, reduce the wage\nrates of any employee.\n(3) No  person shall cause or attempt to cause an employer to discriminate against\nany employee in violation of KRS 337.420 to 337.433 and 337.990(11).\n(4) No employer may discharge or discriminate against any employee by reason of\nany  action taken by such employee to invoke or assist in any manner the\nenforcement of KRS 337.420 to 337.433 and 337.990(11).","path":["KRS Chapter 337"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45484","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:26Z","sha256":"2b716d57a57a26423d655b3c806cc6c661b355807654143c95c54f262ae57f88","source_id":"us-ky","stale":false,"prev":"us-ky/krs-337.420","next":"us-ky/krs-337.425"},"notice":"GroundRules: Original legal text.
