{"data":{"id":"us-ky/krs-337.425","jurisdiction":"us-ky","citation":"KRS 337.425","heading":"Powers of commissioner.","body":"(1) For  this purpose, the commissioner, or the commissioner's authorized\nrepresentative, may enter the place of employment of any employer to inspect\nand copy payrolls and other employment records, to compare character of work\nand  operations on which persons employed by him or her are engaged, to\nquestion such persons, and to obtain other information necessary to the\nadministration and enforcement of KRS 337.420 to 337.433 and 337.990(11).\n(2) The  commissioner or the commissioner's authorized representative may\nexamine witnesses under oath, and require by subpoena the attendance and\ntestimony of witnesses and the production of any documentary evidence\nrelating to the subject matter of any investigation undertaken pursuant to KRS\n337.420 to 337.433 and 337.990(11). If a person fails to attend, testify or\nproduce documents under or in response to a subpoena, the Circuit Court in\nthe judicial circuit where the hearing is being held, on application of the\ncommissioner  or the commissioner's representative, may  issue an order\nrequiring the person to appear before the commissioner or the commissioner's\nauthorized representative, or to produce documentary evidence, and any\nfailure to obey the order of the court may  be punished by the court as\ncontempt.\n(3) The  commissioner may  endeavor to eliminate pay practices unlawful under\nKRS  337.420 to 337.433 and 337.990(11) by informal methods of conference,\nconciliation and persuasion, and supervise the payment of wages owing to any\nemployee under KRS 337.420 to 337.433 and 337.990(11).\n(4) The commissioner may issue regulations not inconsistent with the purpose of\nKRS  337.420 to 337.433 and 337.990(11), necessary or appropriate to carry\nout its provisions.","path":["KRS Chapter 337"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45485","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:26Z","sha256":"e8af58d5fc639ec4372a3dfb12f302c1276b32acbd678afcab72b3749bf7002a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-337.423","next":"us-ky/krs-337.427"},"notice":"GroundRules: Original legal text.
