{"data":{"id":"us-ky/krs-337.427","jurisdiction":"us-ky","citation":"KRS 337.427","heading":"Collection of unpaid wages and other relief.","body":"(1) Any employer who violates the provisions of KRS  337.423 shall be liable to the\nemployee  or employees affected in the amount of their unpaid wages, and in\ninstances of willful violation in employee suits under subsection (2) of this\nsection, up to an additional equal amount as liquidated damages.\n(2) Action to recover the liability may  be maintained in any court of competent\njurisdiction by any one (1) or more employees for and in behalf of himself,\nherself, or themselves and other employees similarly situated. The court in the\naction shall, in cases of violation in addition to any judgment awarded to the\nplaintiff or plaintiffs, allow a reasonable attorney's fee to be paid by the\ndefendant, and costs of the action.\n(3) An  agreement by any employee to work for less than the wage to which the\nemployee is entitled under KRS  337.420 to 337.433 and 337.990(11) shall not\nbe a bar to any such action, or to a voluntary wage restitution of the full amount\ndue under KRS 337.420 to 337.433 and 337.990(11).\n(4) At the written request of any employee claiming to have been paid less than\nthe wage  to which he may  be entitled under KRS  337.420 to 337.433 and\n337.990(11), the commissioner may bring any legal action necessary in behalf\nof the employee to collect the claim for unpaid wages. The commissioner shall\nnot be required to pay the filing fee, or other costs, in connection with the\naction. The commissioner shall have power to join various claims against the\nemployer in one (1) cause of action.\n(5) In proceedings under this section, the court may order other affirmative action\nas appropriate, including reinstatement of employees discharged in violation of\nKRS  337.420 to 337.433 and 337.990(11).\n(6) The  commissioner may  on his or her own  motion petition any court of\ncompetent jurisdiction to restrain violations of KRS  337.423, and petition for\nsuch affirmative relief as the court may deem appropriate, including restoration\nof unpaid wages and reinstatement of employees, consistent with the purpose\nof KRS 337.420 to 337.433 and 337.990(11).","path":["KRS Chapter 337"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45486","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:26Z","sha256":"45fef21aff3b8a8ce46c38ae27dbeca7265eddda1e96416af575e0d955449118","source_id":"us-ky","stale":false,"prev":"us-ky/krs-337.425","next":"us-ky/krs-337.430"},"notice":"GroundRules: Original legal text.
