{"data":{"id":"us-ky/krs-337.990","jurisdiction":"us-ky","citation":"KRS 337.990","heading":"Civil penalties.","body":"The following civil penalties shall be imposed by the Education and Labor Cabinet, in\naccordance with the provisions in KRS  336.985, for violations of the provisions of\nthis chapter:\n(1) Any firm, individual, partnership, or corporation that violates KRS  337.020 shall\nbe assessed a civil penalty of not less than one hundred dollars ($100) nor\nmore than one thousand dollars ($1,000) for each offense. Each failure to pay\nan employee the wages when due him under KRS  337.020 shall constitute a\nseparate offense.\n(2) Any  employer who violates KRS  337.050 shall be assessed a civil penalty of\nnot less than one hundred dollars ($100) nor more than one thousand dollars\n($1,000).\n(3) Any  employer who violates KRS  337.055 shall be assessed a civil penalty of\nnot less than one hundred dollars ($100) nor more than one thousand dollars\n($1,000) for each offense and shall make  full payment to the employee by\nreason of the violation. Each failure to pay an employee the wages as required\nby KRS 337.055 shall constitute a separate offense.\n(4) Any  employer who violates KRS  337.060 shall be assessed a civil penalty of\nnot less than one hundred dollars ($100) nor more than one thousand dollars\n($1,000) and shall also be liable to the affected employee for the amount\nwithheld, plus interest at the rate of ten percent (10%) per annum.\n(5) Any employer who violates the provisions of KRS  337.065 shall be assessed a\ncivil penalty of not less than one hundred dollars ($100) nor more than one\nthousand dollars ($1,000) for each offense and shall make full payment to the\nemployee by reason of the violation.\n(6) Any  person who fails to comply with KRS  337.070 shall be assessed a civil\npenalty of not less than one hundred dollars ($100) nor more  than one\nthousand dollars ($1,000) for each offense and each day that the failure\ncontinues shall be deemed a separate offense.\n(7) Any  employer who violates any provision of KRS  337.275 to 337.325, KRS\n337.345, and KRS  337.385 to 337.405, or willfully hinders or delays the\ncommissioner  or  the commissioner's authorized representative in the\nperformance of his or her duties under KRS  337.295, or fails to keep and\npreserve any records as required under KRS  337.320 and 337.325, or falsifies\nany record, or refuses to make any record or transcription thereof accessible to\nthe commissioner or the commissioner's authorized representative shall be\nassessed a civil penalty of not less than one hundred dollars ($100) nor more\nthan one thousand dollars ($1,000). A civil penalty of not less than one\nthousand dollars ($1,000) shall be assessed for any subsequent violation of\nKRS  337.285(4) to (9) and each day the employer violates KRS  337.285(4) to\n(9) shall constitute a separate offense and penalty.\n(8) Any  employer who pays or agrees to pay wages at a rate less than the rate\napplicable under KRS  337.275 and 337.285, or any wage  order issued\npursuant thereto shall be assessed a civil penalty of not less than one hundred\ndollars ($100) nor more than one thousand dollars ($1,000).\n(9) Any  employer who discharges or in any other manner discriminates against\nany employee because the employee has made  any complaint to his or her\nemployer,  to the commissioner, or to the commissioner's authorized\nrepresentative that he or she has not been paid wages in accordance with KRS\n337.275  and  337.285 or regulations issued thereunder, or because  the\nemployee has caused to be instituted or is about to cause to be instituted any\nproceeding under or related to KRS  337.385, or because the employee has\ntestified or is about to testify in any such proceeding, shall be deemed  in\nviolation of KRS  337.275 to 337.325, KRS  337.345, and KRS  337.385 to\n337.405 and shall be assessed a civil penalty of not less than one hundred\ndollars ($100) nor more than one thousand dollars ($1,000).\n(10) Any  employer who violates KRS  337.365 shall be assessed a civil penalty of\nnot less than one hundred dollars ($100) nor more than one thousand dollars\n($1,000).\n(11) A person shall be assessed a civil penalty of not less than one hundred dollars\n($100) nor more  than one  thousand dollars ($1,000) when  that person\ndischarges or in any other manner discriminates against an employee because\nthe employee has:\n(a) Made  any complaint to his or her employer, the commissioner, or any\nother person; or\n(b) Instituted, or caused to be instituted, any proceeding under or related to\nKRS  337.420 to 337.433; or\n(c) Testified, or is about to testify, in any such proceedings.","path":["KRS Chapter 337"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52428","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:26Z","sha256":"00f69e8fafb1c8f1a9c987201616c7711de6106907fbffacee9fc5654f2fb537","source_id":"us-ky","stale":false,"prev":"us-ky/krs-337.550","next":"us-ky/krs-337.991"},"notice":"GroundRules: Original legal text.
