{"data":{"id":"us-ky/krs-338.015","jurisdiction":"us-ky","citation":"KRS 338.015","heading":"Definitions for chapter.","body":"As used in this chapter:\n(1) \"Employer\" shall mean any entity for whom  a person is employed except those\nemployers excluded in KRS 338.021;\n(2) \"Employee\"  shall mean  any  person employed  except those employees\nexcluded in KRS 338.021;\n(3) The  term \"occupational safety and health standard\" means  a standard which\nrequires conditions, or the adoption or use of one (1) or more practices, means,\nmethods, operations, or processes, reasonably necessary or appropriate to\nprovide safe or healthful employment and places of employment. \"Standard\"\nhas the same meaning as and includes the words \"regulation\" and \"rule\";\n(4) \"Occupational safety and health hazard\" means any practice or condition in a\nplace of employment which may  be deemed  detrimental to the safety and\nhealth of employees;\n(5) \"Occupational injury or illness\" means any abnormal condition or disorder of an\nemployee  caused  by  exposure  to factors associated with his or her\nemployment;\n(6) \"Board\" means the Kentucky Occupational Safety and Health Standards Board\nestablished under this chapter;\n(7) \"Commissioner\" means  the commissioner of the Department of Workplace\nStandards under the direction and supervision of the secretary of the Education\nand Labor Cabinet;\n(8) \"Review commission\" means  the Kentucky Occupational Safety and Health\nReview Commission established under this chapter;\n(9) The  term \"national consensus standard\" means  any occupational safety and\nhealth standard or modification thereof which  has  been  adopted  and\npromulgated by a nationally recognized standards-producing organization;\n(10) The  term \"established federal standard\" means  any operative occupational\nsafety and health standard established by any agency of the United States\ngovernment;\n(11) \"Department\" means the Department of Workplace Standards; and\n(12) \"Secretary\" means the secretary of the Education and Labor Cabinet.","path":["KRS Chapter 338"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52430","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"07595ae3715976cb077bb62895ff3f15f062e37fc2f5ee9de131642e7e0763b1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-338.011","next":"us-ky/krs-338.020"},"notice":"GroundRules: Original legal text.
