{"data":{"id":"us-ky/krs-338.071","jurisdiction":"us-ky","citation":"KRS 338.071","heading":"Kentucky  Occupational Safety and Health Review  Commission  --","body":"Membership  -- Terms  -- Quorum  -- Hearings  -- Regulations  --\nCompensation  -- Employees.\n(1) There  is hereby established the Kentucky Occupational Safety and Health\nReview  Commission  consisting of three (3) members  appointed by the\nGovernor on the basis of their experience and competence in the fields of\noccupational safety and health. The members  selected shall be qualified to\nrepresent the interest of employers, employees, and the occupational safety\nand  health profession with a minimum  of five (5) years experience in their\nrespective fields.\n(2) Members  of the review commission shall serve terms of four (4) years and until\ntheir successors are appointed.\n(3) The  review commission shall hold monthly meetings and additional meetings\nas  deemed  necessary. A majority of the review commission constitutes a\nquorum  for the transaction of business. Special meetings of the review\ncommission may be called upon reasonable notice by the commissioner or by\nany two (2) members  of the commission.\n(4) The  review commission  shall hear and  rule on  appeals from citations,\nnotifications, and variances issued under the provisions of this chapter and\nadopt and promulgate rules and regulations with respect to the procedural\naspect of its hearings.\n(5) The review commission shall have the authority to employ a secretary, hearing\nofficers, and other employees as may become necessary.\n(6) The chairman of the commission and each of the other two (2) members  shall\nbe paid a salary fixed under KRS 64.640.\n(7) The  secretary of the commission shall be paid a salary to be fixed by the\ncommission, with the approval of the Governor. The commission shall fix the\ncompensation of all its other employees.\n(8) The  commissioners and the secretary and employees of the commission are\nentitled to all necessary expenses incurred in traveling on business of the\ncommission.\n(9) The  commission shall be attached to the Education and Labor Cabinet for\nadministrative purposes only.","path":["KRS Chapter 338"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52433","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"e9ad780e174dbacfb3d738e9776eeb5a6c816b99172adc43fa97c3259ad5705e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-338.070","next":"us-ky/krs-338.080"},"notice":"GroundRules: Original legal text.
