{"data":{"id":"us-ky/krs-338.091","jurisdiction":"us-ky","citation":"KRS 338.091","heading":"Appeals -- Procedure -- Administrative regulations.","body":"(1) Any party adversely affected or aggrieved by a final order of the review\ncommission may appeal within thirty (30) days to the Franklin Circuit Court on the\nrecord for a review of such order. No new evidence may be introduced in the\nCircuit Court. An appeal may be taken to the Court of Appeals from any decision of\nthe Circuit Court under this section.\n(2) On appeal, the Franklin Circuit Court may award actual expenses incurred,\nincluding court costs and attorney's fees, against the department.\n(3) The depart ment shall promulgate administrative regulations in accordance with\nKRS Chapter 13A to implement this section. The administrative regulations shall\ncomply with the Equal Access to Justice Act, 28 U.S.C. sec. 2412.\n(4) The commencement of a proceeding under  this section shall operate as a stay of an\norder of the review commission.","path":["KRS Chapter 338"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56360","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"9c1be4e13c5b122808f4ef33ae1a6db5bdd83fc032f9f456e344002cf216d9e1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-338.090","next":"us-ky/krs-338.100"},"notice":"GroundRules: Original legal text.
