{"data":{"id":"us-ky/krs-338.101","jurisdiction":"us-ky","citation":"KRS 338.101","heading":"Authority of commissioner.","body":"(1) In order to carry out the purposes of this chapter, the commissioner or the\ncommissioner's authorized representative shall have the authority:\n(a) To enter without delay and advance notice any place of employment during\nregular working hours and at other r easonable times in order to inspect such\nplaces, question privately any such employer, owner, operator, agent,\nemployee, or employee's representative, and investigate such facts, conditions,\npractices, or matters deemed appropriate to determine the cause o f, or to\nprevent the occurrence of, any occupational injury or illness.\n(b) To administer oaths, take depositions, conduct hearings, take photographs,\nreview any and all accident and illness records, and secure any other evidence\ndeemed necessary to evalua te any occupational safety and health hazard in\norder to ascertain whether any person has violated any provision of this\nchapter or regulations issued pursuant thereto.\n(2) If an employer refuses such entry, then the commissioner may apply to the Franklin\nCircuit Court for an order to enforce the right of entry.","path":["KRS Chapter 338"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32134","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"e8b610de0bea92c481fcfaef5965ea943bdab3198f2177326e1b8e23ed2f3043","source_id":"us-ky","stale":false,"prev":"us-ky/krs-338.100","next":"us-ky/krs-338.110"},"notice":"GroundRules: Original legal text.
