{"data":{"id":"us-ky/krs-338.131","jurisdiction":"us-ky","citation":"KRS 338.131","heading":"Abatement of danger -- Commissioner may apply for injunction.","body":"(1) Whenever an authorized representative of the commissioner determines that\nconditions in any place of employment are of an imminent danger which reasonably\ncould be expected to cause death or serious physical harm, then he or she shall order\nthe danger to b e immediately abated. Any order issued under this section may\nrequire such steps to be taken as may be necessary to avoid, correct, or remove such\nimminent danger and prohibit the employment or presence of any individual in\nlocations or under conditions wh ere such imminent danger exists, except\nindividuals whose presence is necessary to avoid, correct, or remove such imminent\ndanger or to maintain the capacity of a continuous process operation to resume\nnormal operations without a complete cessation of oper ations, or where a cessation\nof operations is necessary, to permit such to be accomplished in a safe and orderly\nmanner.\n(2) In the event the danger is not abated immediately, the commissioner shall apply to\nthe Franklin Circuit Court for an order to restrain such condition or practice.","path":["KRS Chapter 338"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32140","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"d399386c41e0a7f02e6cf7c65a978aaf0f9339c534acfbe3b77931d191af7e8c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-338.130","next":"us-ky/krs-338.133"},"notice":"GroundRules: Original legal text.
