{"data":{"id":"us-ky/krs-338.201","jurisdiction":"us-ky","citation":"KRS 338.201","heading":"Lien on property of employer who  violates provisions of chapter --","body":"Recording of lien.\n(1) A lien may be placed on all property, both real and personal, of an employer\nwho  has violated any requirement of this chapter, if the citation issued by the\ncommissioner has been upheld by a final order of the review commission, but\nnot before all administrative and judicial appeals have been exhausted. The\nlien shall be in favor of the Education and Labor Cabinet and shall be an\namount  totaling the penalties due, together with interest at a rate of twelve\npercent (12%) per annum  from the date the order of the review commission is\nfinal, but not before all administrative and  judicial appeals have  been\nexhausted. The lien shall be attached to all property and rights to property\nowned  or subsequently acquired by the employer. The commissioner or the\ncommissioner's designee shall record the lien as provided in subsection (2) of\nthis section. The lien shall show the date on which the citation was issued, the\ndate of the violation, the name and last known address of the employer against\nwhom  the assessment was made, and the amount of penalties and interest.\nThe  lien shall be superior to the lien of any mortgage or encumbrance\nthereafter created and shall continue for ten (10) years from the time of the\nrecording, unless sooner released or otherwise discharged.\n(2) The lien shall be filed in any of the following offices in which the employer owns\nproperty or rights to property and any filing fees associated with filing the lien\nshall be pursuant to KRS 64.012:\n(a) The  office of the county clerk of the county in which the defendant\nemployer resides.\n(b) The  office of the county clerk of the county in which the defendant\nemployer has its principal place of business.\n(c) The  office of the county clerk of any county in which the defendant\nemployer has property or an interest in property.","path":["KRS Chapter 338"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52436","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"d9490d996d6cc6c066c8a14d48667fa6e9132c6053049d381fd69577288f2180","source_id":"us-ky","stale":false,"prev":"us-ky/krs-338.200","next":"us-ky/krs-338.990"},"notice":"GroundRules: Original legal text.
