{"data":{"id":"us-ky/krs-339.210","jurisdiction":"us-ky","citation":"KRS 339.210","heading":"Definition of \"gainful occupation.\"","body":"As used in KRS 339.210 to 339.450:\n(1) \"Gainful occupation\" does not include employment in farm work or in domestic\nservice in a private home, nor occasional employment by a householder in\nconnection with the household and not in connection with the householder's\nbusiness or occupation, such as  grass cutting or carrying ashes or similar casual\ndomestic tasks, nor the delivery of newspapers on regularly scheduled routes, nor to\nemployment as an actor or performer in motion pictures or theatrical productions,\nor in radio or television productions,  nor to employment of minors by their own\nparents or persons standing in the place of a parent in occupations other than\nmanufacturing, mining, or those found by the commissioner of the Department of\nWorkplace Standards to be particularly hazardous;\n(2) \"Gainful occupation\" does not include a minor who is at least twelve (12) years of\nage working as a referee, umpire, or official in a youth athletic program, subject to\nthe following:\n(a) The minor is a referee, umpire, or official for an age bracket younger  than the\nminor's own age;\n(b) An adult representing the youth athletic program is on the premises where the\nathletic event is occurring; and\n(c) The minor has on file with the person responsible for assigning the minor to\nofficiate for the youth athletic program the original or a copy of a written\nconsent to the child's employment as a referee, umpire, or official signed by\nthe minor's parent or guardian; and\n(3) \"Gainful occupation\" does not include participation in a work program established\nunder KRS 339.335 by a minor who is twelve (12) or thirteen (13) years of age.","path":["KRS Chapter 339"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55023","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:27Z","sha256":"b57845215007ffacb8358260d4eb2431170f1ad4187bf2073937f1de4351102a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-339.205","next":"us-ky/krs-339.220"},"notice":"GroundRules: Original legal text.
