{"data":{"id":"us-ky/krs-341.067","jurisdiction":"us-ky","citation":"KRS 341.067","heading":"Hospitals and institutions of higher education.","body":"As used in this chapter, unless the context clearly requires otherwise:\n(1) \"Hospital\" means an institution which has been licensed, certified, or approved by\nthe secretary for health and family services as a hospital;\n(2) \"Institution of higher education\" means an educational institution which:\n(a) Admits as regular students only individuals having a certificate of graduation\nfrom a high school, or the recognized equivalent of such a certificate;\n(b) Is legally authorized in this state to provide a program  of education beyond\nhigh school;\n(c) Provides an educational program for which it awards a bachelor's or higher\ndegree, or provides a program which is acceptable for full credit toward such a\ndegree, a program of postgraduate or postdoctoral studies, or a  program of\ntraining to prepare students for gainful employment in a recognized\noccupation; and\n(d) Is a public or other nonprofit institution;\n(3) Notwithstanding any of the foregoing provisions of this section, all recognized\ncolleges and universities in  this state are institutions of higher education for\npurposes of this chapter; and\n(4) (a) \"Educational institution,\" including an institution of higher education as\ndefined in subsection (2) of this section, means:\n1. A school in which participants, train ees, or students are offered an\norganized course of study or training designed to transfer to them\nknowledge, skills, information, doctrines, attitudes or abilities from, by,\nor under the guidance of an instructor or teacher;\n2. It is approved, licensed, or issued a permit to operate as a school by the\nState Department of Education or other government agency that is\nauthorized within the state to approve, license, or issue a permit for the\noperation of a school; and\n3. The courses  of study or training which it offers may be academic,\ntechnical, trade, or preparation for gainful employment in a recognized\noccupation.\n(b) In any particular case, the question of whether or not an institution is an\neducational institution within the me aning of the criteria described above will\ndepend on what that particular institution actually does.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32239","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:28Z","sha256":"a2dc986235a7c756ce52a0be4a2ce31a576b3a73b93f96bca933bb4eb8e4e9e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.065","next":"us-ky/krs-341.069"},"notice":"GroundRules: Original legal text.
