{"data":{"id":"us-ky/krs-341.094","jurisdiction":"us-ky","citation":"KRS 341.094","heading":"Extended benefit period -- State \"on\" and \"off\" indicators -- Triggers.","body":"As used in this chapter, unless the context clearly requires otherwise:\n(1) \"Extended benefit period\" means a period which:\n(a) Begins with the third week after a week for which there is a state \"on\"\nindicator; and\n(b) Ends with either of the following weeks, whichever occurs later:\n1. The third week after the first week for which there is a state \"off\"\nindicator; or\n2. The thirteenth consecutive week of such period; provided, that no\nextended benefit period may begin by reason of a state \"on\" indicator\nbefore the fourteenth week following the end of a prior extended benefit\nperiod which was in effect with respect to this state.\n(2) There is a \"state 'on' indicator\" for this state for a week if the secretary determines,\nin accordance with the regulations of the United States Secretary of Labor, that for\nthe period consisting of such week and the immediately preceding twelve (12)\nweeks, the rate of insured unemployment (not seasonally adjusted) under this\nchapter:\n(a) Equaled or exceeded one hundred twenty per cent (120%) of the average of\nsuch rates for the corresponding 13 -week period ending in each of the\npreceding two (2) calendar years, and\n(b) Equaled or exceeded five percent (5%).\n(3) Notwithstanding subsection (2) of this section, there is a \"state 'on' indicator\" for\nthis state with respect to weeks of unemployment until the week ending four (4)\nweeks prior to the last week of unemployment for which one hundred percent\n(100%) federal sharing is available under Section 2005(a) of the American\nRecovery and Reinvestment Act of 2009 (ARRA), Pub. L. No. 111 -5, or a similar\nprovision in effect, without regard to the extension of federal sharing for certain\nclaims as provided under Section 2005(c) of ARRA if:\n(a) The average rate of total unemployment (seasonall y adjusted), as determined\nby the United States Secretary of Labor, for the period consisting of the most\nrecent three (3) months for which data for all states are published before the\nclose of such week equals or exceeds six and one-half percent (6.5%); and\n(b) The average rate of total unemployment in this state (seasonally adjusted), as\ndetermined by the United States Secretary of Labor, for the three (3) month\nperiod referred to in paragraph (a) of this subsection equals or exceeds one\nhundred ten perce nt (110%) of such average for either or both of the\ncorresponding three (3) month periods ending in the preceding two (2)\ncalendar years.\n(4) There is a \"state 'off' indicator\" for this state for a week if, for the period consisting\nof such week and the immediately preceding twelve (12) weeks, paragraph (a) or (b)\nof subsection (2) of this section or subsection (3) of this section was not satisfied.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32245","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:28Z","sha256":"32fe2a9e9a602cf1c1a844279e3f54318b3a8e0d4a407452340c1d6da76dc2cb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.092","next":"us-ky/krs-341.096"},"notice":"GroundRules: Original legal text.
