{"data":{"id":"us-ky/krs-341.100","jurisdiction":"us-ky","citation":"KRS 341.100","heading":"Suitable work.","body":"(1) In determining for any purpose under this chapter whether or not any work is\nsuitable for a worker the secretary shall consider, among other pertinent conditions,\nthe degree of risk involved to his or her health, safety and morals; his or her\nphysical fitness and prior training; his or her experience and prior earnings; his or\nher length of unemployment and prospects for securing local work in his or her\ncustomary occupation; and the distance of the available work from his or her\nresidence. The secretary shall consider any employment offer to be suitable work:\n(a) That is offered to a worker who has received at least six (6) weeks of benefits\nduring his or her present period of unemployment;\n(b) For which the worker will be paid one hundred twenty percent (1 20%) of his\nor her weekly benefit amount;\n(c) That is located within a distance of thirty (30) miles of the worker's residence,\nor is work that can be completed remotely on a permanent basis; and\n(d) That the worker is able and qualified to perform, regard less of whether or not\nhe or she has related experience or training.\n(2) For the purpose of this chapter, no work shall be suitable nor shall benefits be\ndenied under this chapter to any otherwise eligible worker for refusing to accept\nnew work or new conditions of work under one (1) or more of the following:\n(a) If the position offered is vacant due directly to a strike, lock -out or other labor\ndispute;\n(b) If the wages, hours, or other conditions of the work offered are substantially\nless favorable than those prevailing for similar work in the locality;\n(c) If, as a condition of being employed, the worker would be required to join a\ncompany union or to resign from or refrain from joining any bona fide labor\norganization; and\n(d) If the acceptance of such w ork would be prejudicial to the continuance of an\nestablished employer-employee relationship to which the worker is a party.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54206","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:28Z","sha256":"753a4611a62dfcf2cd00b5b3793b6f7add57555e2a0e20c4363619c837a9f928","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.096","next":"us-ky/krs-341.102"},"notice":"GroundRules: Original legal text.
