{"data":{"id":"us-ky/krs-341.125","jurisdiction":"us-ky","citation":"KRS 341.125","heading":"Secretary of Education and Labor Cabinet -- Powers  and duties --","body":"Personnel.\n(1) It shall be the duty of the secretary of the Education and Labor Cabinet to\nadminister this chapter; and he shall have power and authority to make such\nexpenditures, require such reports, make  such investigations, and take such\nother action not specifically assigned to the cabinet, as he or she deems\nnecessary for the proper administration of this chapter.\n(2) The secretary is authorized, subject to the provisions of KRS  Chapters 12, 42,\n45, and 45A, to appoint, fix the compensation, and prescribe duties and powers\nof such officers and employees as may be necessary in the performance of his\nor her duties under this chapter. All positions shall be filled by persons selected\nand appointed on a nonpartisan merit basis. The secretary shall not employ or\npay any person who is an officer or committee member  of any political party\norganization. The secretary may  delegate to any such person so appointed\nsuch power and authority as he or she deems  reasonable and proper for the\neffective administration of this chapter.\n(3) The  salary and expenses of the secretary and his or her staff shall be\nconsidered a proper cost of the administration of this chapter, to be charged to\nthe unemployment compensation administration fund in that proportion which\nthe cost of such services rendered in the administration of this chapter bears to\nthe overall cost of the services rendered in the administration of the cabinet.\n(4) The  secretary shall submit to the Governor an annual report covering the\nadministration and operation of this chapter and make such recommendations\nfor amendments  to this chapter as he or she deems proper.\n(5) In the administration of this chapter the secretary shall cooperate to the fullest\nextent possible with any agency of this state or any other state or of the United\nStates and shall take such action, through the adoption of appropriate rules,\nregulations, administrative methods, and standards, as may be necessary to\nsecure for this state and its citizens all the advantages available under the\nprovisions of the Social Security Act, as amended, that relate to unemployment\ncompensation,  the Federal Unemployment  Tax  Act, as  amended,  the\nWagner-Peyser  Act, as  amended,  and  the  Federal-State Extended\nUnemployment  Compensation Act of 1970.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52442","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:28Z","sha256":"1c84b1855f8b2086294b13f1c87671e6f852d26c24a26715cd0db2416047d671","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.120","next":"us-ky/krs-341.126"},"notice":"GroundRules: Original legal text.
