{"data":{"id":"us-ky/krs-341.300","jurisdiction":"us-ky","citation":"KRS 341.300","heading":"Interest on  unpaid contributions -- Collection of contributions,","body":"interest, or penalties.\n(1) Contributions unpaid on the date on which they are due and payable, as\nprescribed by the secretary, shall be subject to interest at the rate of one and\nfive-tenths percent (1.5%) per month or fraction thereof, not to exceed ninety\npercent (90%) of the amount of such contributions, from and after such date\nuntil payment is received by the Office of Unemployment Insurance irrespective\nof whether such delinquency has been reduced to a judgment or not as\nprovided in subsection (2) of this section or is the subject of an administrative\nappeal or court action. The interest charged for a month, in which the unpaid\ncontributions remain unpaid, shall be considered accrued and therefore due\nand owing on the first day after the last day of the month in which the balance\nis due. Such  interest shall be paid into the unemployment  compensation\nadministration fund.\n(2) If, after due  notice, any  subject employer defaults in any  payment  of\ncontributions, interest or penalties thereon, the amount due shall be collected\nby a civil action instituted in the Franklin Circuit Court or the Franklin District\nCourt  depending upon  the jurisdictional amount  in controversy including\ninterest and penalties in the name  of the state, and the subject employer\nadjudged in default shall pay the costs of the action. Civil actions brought under\nthis section shall be heard by the court, without the intervention of a jury, at the\nearliest possible date, and shall be entitled to preference upon the calendar of\nthe court over all other civil actions except petitions for judicial review under\nthis chapter and cases arising under the workers' compensation law.\n(3) At or after the commencement  of an action under subsection (2) of this section,\nattachment may be had against the property of the liable subject employer for\nsuch contributions, interest, and penalties, without the execution of a bond, or\nafter judgment has been entered an execution may  be issued against the\nproperty of such employer without the execution of a bond.\n(4) An  action for the recovery of contributions, interest, or penalties under this\nsection shall be  barred and  any  lien therefor shall be  canceled and\nextinguished unless collected or suit for collection has been filed within ten (10)\nyears from the due date of such contributions, except, in the case of the filing\nof a false or fraudulent report, the contributions due shall not be barred and\nmay  at any time be collected by the methods set out in this chapter, including\naction in a court of competent jurisdiction.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52450","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"c95d1584d1af9e8a74c5812785696ea67e5bcd80d5966f118c90b7fc60c70be0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.296","next":"us-ky/krs-341.301"},"notice":"GroundRules: Original legal text.
