{"data":{"id":"us-ky/krs-341.385","jurisdiction":"us-ky","citation":"KRS 341.385","heading":"Duration of benefits -- Application of classification system -- Extension of","body":"benefits -- Additional weeks for job training or certification participation.\n(1) The duration of benefits available to each eligible recipient based upon the st ate\naverage unemployment rate at the time of his or her application for benefits, up to a\nmaximum of twenty-four (24) weeks, shall be as follows:\n(a) State average unemployment rate of less than or equal to six and one -half\npercent (6.5%): sixteen (16) weeks of benefits available;\n(b) State average unemployment rate of greater than six and one -half percent\n(6.5%) up to and including seven percent (7%): seventeen (17) weeks of\nbenefits available;\n(c) State average unemployment rate of greater than seven percent (7%) up to and\nincluding seven and one -half percent (7.5%): eighteen (18) weeks of benefits\navailable;\n(d) State average unemployment rate of greater than seven and one -half percent\n(7.5%) up to and including eight percent (8%): nineteen (19) weeks of\nbenefits available;\n(e) State average unemployment rate of greater than eight percent (8%) up to and\nincluding eight and one -half percent (8.5%): twenty (20) weeks of benefits\navailable;\n(f) State average unemployment rate of greater than eight and one -half percent\n(8.5%) up to and including nine percent (9%): twenty -one (21) weeks of\nbenefits available;\n(g) State average unemployment rate of greater than nine percent (9%) up to and\nincluding nine and one -half percent (9.5%): twenty -two (22) weeks of\nbenefits available;\n(h) State average unemployment rate of greater than nine and one -half percent\n(9.5%) up to and including ten percent (10%): twenty -three (23) weeks of\nbenefits available; and\n(i) State average unemployment rate of greater than ten percent (10 %): twenty-\nfour (24) weeks of benefits available.\n(2) The classification system set forth in subsection (1) of this section shall apply to\nregular benefits and shall not affect the duration of shared work benefits as set forth\nin KRS 341.4161 to 341.4173.\n(3) A claimant who has been classified with a group classific ation code by the agency\nthat meets the requirements of subsection (1) of this section shall remain in this\nclassification throughout the benefit year regardless of whether or not the claimant's\nclassification changes.\n(4) The secretary may, with the appro val of the General Assembly, extend the\nmaximum amount of regular benefits payable, not to exceed twenty -six (26) times\nthe claimant's weekly benefit rate, if:\n(a) An extension for benefits is authorized by the federal government, but only\nwhile federal funding is available; or\n(b) During, but not exceeding, any extended benefit period as described in KRS\n341.094.\n(5) (a) Any otherwise eligible individual who is certified as being enrolled and\nmaking satisfactory progress in an approved job training or cert ification\nprogram shall be entitled, during the current benefit year, to receive up to an\nadditional five (5) weeks of benefits after all regular benefits have been\nexhausted under subsection (1) of this section.\n(b) The amount of benefits payable under th is subsection shall equal the weekly\nbenefit amount established by the most recent benefit year.\n(c) Benefits under this subsection shall not be paid to an individual who is\nreceiving benefits of comparable value or other training allowances from\nother unrelated sources.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54211","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"90e031c6c2a02cbc1970e991e6c056e20ed3ddb5bf457a1faa52e27f42ceeafc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.380","next":"us-ky/krs-341.390"},"notice":"GroundRules: Original legal text.
