{"data":{"id":"us-ky/krs-341.390","jurisdiction":"us-ky","citation":"KRS 341.390","heading":"Deductions from benefits.","body":"There shall be deducted from the benefit rate determined for a worker in accordance with\nsubsection (2) of KRS 341.380:\n(1) Eighty percent (80%), adjusted to the nearest multiple of one dollar ($1), of the\namount of wages earned by such worker during the w eek of unemployment with\nrespect to which he claims benefits. For the purpose of this subsection, wages shall\nalso include amounts earned by benefit claimants in self employment provided such\nearnings otherwise meet the definition of wages as contained in KRS 341.030;\n(2) The amount of remuneration which the worker has received or is receiving with\nrespect to such week of unemployment (adjusted to the nearest multiple of one\ndollar ($1)) in the form of remuneration in lieu of notice; and\n(3) (a) The amount of compensation payable to an individual for any week which\nbegins after March 31, 1980, and which begins in a period with respect to\nwhich such individual is receiving a governmental or other pension,\nretirement or retired pay, annuity, or any other similar periodic payment under\na plan maintained or contributed to a chargeable or base -period employer,\nshall be reduced (but not below zero (0)) by an amount equal to the amount of\nsuch pension, retirement or retired pay, annuity, or other payment which is\nreasonably attributable to such week; except that this reduction shall not be\nmade if the worker contributed to the pension, retirement or retired pay,\nannuity, or other similar periodic payment.\n(b) No reduction shall be made under this section by reason of  the receipt of a\npension if the services performed by the worker during the base period (or\nremuneration received for such services) for such employer did not affect the\nworker's eligibility for, or increase the amount of, such pension, retirement or\nretired pay, annuity, or other similar periodic payment. The conditions\nspecified by this subsection shall not apply to pensions paid under the Social\nSecurity Act or the Railroad Retirement Act of 1974 (or the corresponding\nprovisions of prior law). Payments made under such acts shall be treated\nsolely in the manner specified by paragraph (a) of this subsection.\n(c) If Public Law 94 -566, Public Law 96 -364 or the federal act which amends\neither for any cause shall become inoperative in its application, or staye d\npendente lite, as to deductions of such compensation, then subsection (3) of\nthis section, by virtue of that fact, shall likewise and to the same extent\nbecome inoperative as to such deductions.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32298","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"7bf66117e8b82b2adc34c3637ba7640d08d94c266958731b6f3fec3211943577","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.385","next":"us-ky/krs-341.392"},"notice":"GroundRules: Original legal text.
