{"data":{"id":"us-ky/krs-341.392","jurisdiction":"us-ky","citation":"KRS 341.392","heading":"Deduction and withholding of child support obligations from benefits.","body":"(1) A worker filing a new claim for unemployment benefits shall, at the time of filing\nsuch claim, disclose whether or not he owes child support obligations as defined\nunder this section. If any such worker discloses that he owes child support\nobligations, and  is determined to be eligible for unemployment benefits, the\nsecretary shall notify the state or local child support enforcement agency enforcing\nsuch obligation that the worker has been determined to be eligible for\nunemployment benefits.\n(2) The secretary shall deduct and withhold from any unemployment benefits payable\nto a worker that owes child support obligations:\n(a) The amount specified by the worker to the secretary to be deducted and\nwithheld under this subsection, if neither (b) nor (c) applies;\n(b) The amount, if any, determined pursuant to an agreement submitted to the\nsecretary under 42 U.S.C. sec. 654 (Section 454(20)(b)(i) of the Social\nSecurity Act) by the state or local child support enforcement agency if (c) is\nnot applicable; or\n(c) Any am ount required to be so deducted and withheld from such\nunemployment benefits pursuant to legal process as that term is defined in the\nSocial Security Act properly served upon the secretary.\n(3) (a) Any amount deducted and withheld under this section shall be paid by the\nsecretary to the appropriate state or local child support enforcement agency.\n(b) Any amount deducted and withheld under this section shall for all purposes be\ntreated as if it were paid to the worker as unemployment benefits and paid by\nsuch worker to the state or local child support enforcement agency in\nsatisfaction of the worker's child support obligations.\n(4) For purposes of this section, the term \"unemployment benefits\" shall mean any\ncompensation payable under this chapter (including amounts payable by the\nsecretary pursuant to an agreement under any federal law providing compensation,\nassistance, or allowances with respect to unemployment).\n(5) The provisions set forth in this section apply only if appropriate arrangements have\nbeen m ade for reimbursement by the state or local child support enforcement\nagency for the administrative costs incurred by the secretary under this section\nwhich are attributable to child support obligations being enforced by the state or\nlocal child support enforcement agency.\n(6) The term \"child support obligations\" is defined for purposes of these provisions as\nincluding only obligations which are being enforced pursuant to a plan prescribed in\n42 U.S.C. sec. 654 (Section 454 of the Social Security Act) which  has been\napproved by the Secretary of Health and Human Services under 42 U.S.C. secs.\n651-662 (Part D of Title IV of the Social Security Act).\n(7) The term \"state or local child support enforcement agency\" as used in these\nprovisions means any agency of a  state or a political subdivision thereof operating\npursuant to a plan described in this section.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32299","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"b0cc104e3c52aea5b5cb7ab99bd70b3ca28342cd07ce49476c222fe22bcbc572","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.390","next":"us-ky/krs-341.395"},"notice":"GroundRules: Original legal text.
