{"data":{"id":"us-ky/krs-341.4167","jurisdiction":"us-ky","citation":"KRS 341.4167","heading":"Revocation of approved plan -- Annual review of approved plan","body":"operation.\n(1) For purposes of this section, \"good cause\" includes but is not limited to:\n(a) Failure to comply with the assurances given in the plan;\n(b) Unreasonable revision of productivity standards for the affected group;\n(c) Conduct or occurrences tending to defeat the intent and effective operation of\nthe plan; and\n(d) Violation of any criteria on which approval of the plan was based.\n(2) The secretary may revoke approval of a plan:\n(a) For good cause; and\n(b) By issuing a revocation order, in writing, that specifies the date the revocation\nis effective and the reasons for the revocation.\n(3) The secretary may issue a revocation at any time upon his or her own motion or on\nmotion of any of the affected group's employees.\n(4) The secretary shall review the operation of each approved employer plan at least\nonce during the twelve (12) month period that the plan is in effect to ensure its\ncompliance with the requirements of KRS 341.4161 to 341.4173.\n(5) Revocation of a plan for good cause by the secretary shall preclude approval of any\nsubsequent plan submitted by the revoked plan employer during the twelve (12)\nmonth period beginning on the date of the revocation order.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53252","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"f9d69ef6402d21681b071f0ee3a6066ebfc97775071193f2a36d84ef14d23cd8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.4165","next":"us-ky/krs-341.4169"},"notice":"GroundRules: Original legal text.
