{"data":{"id":"us-ky/krs-341.420","jurisdiction":"us-ky","citation":"KRS 341.420","heading":"Appointment of referees -- Appeals -- Effect on other proceedings.","body":"(1) The  secretary shall appoint one (1) or more impartial referees according to\nKRS  341.125 to hear and decide appealed claims.\n(2) A  party to a determination may file an appeal to a referee as to any matter\ntherein within thirty (30) days after the date such determination was mailed to\nhis last known address.\n(3) If benefits are allowed by a determination of the secretary, or a decision of a\nreferee, the commission, the secretary, or a reviewing-court, such benefits shall\nbe paid promptly without regard to the pendency of an appeal or period for\nfiling an appeal therefrom. If a determination or decision allowing benefits is\nmodified or reversed by a subsequent determination or decision, benefits shall\nbe paid or denied for weeks of unemployment thereafter in accordance with\nsuch modification or denial. No injunction, supersedeas, stay or other writ or\nprocess suspending payment of such benefits shall be issued.\n(4) Unless  such appeal is withdrawn, a referee, after affording the parties\nreasonable  opportunity for a  fair hearing, shall affirm or modify the\ndetermination. The parties shall be duly notified of his decision, together with\nthe reasons therefor, which shall be deemed  to be the final decision unless\nwithin thirty (30) days after the date of mailing of such decision, further appeal\nis initiated under KRS 341.430.\n(5) No finding of fact or law, judgment, conclusion, or final order made with respect\nto a claim for unemployment  compensation under this chapter may  be\nconclusive or binding in any separate or subsequent action or proceeding in\nanother forum, except proceedings under this chapter, regardless of whether\nthe prior action was between the same or related parties or involved the same\nfacts.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50702","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"489fc4f3cde51caa012dcf9fa10a499db45fc09bcb6d69b98a56f61f72407d01","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.4173","next":"us-ky/krs-341.430"},"notice":"GroundRules: Original legal text.
