{"data":{"id":"us-ky/krs-341.510","jurisdiction":"us-ky","citation":"KRS 341.510","heading":"Withdrawals from trust fund -- Governor may request transfer of funds","body":"from federal unemployment trust fund.\n(1) Except as provided in subsection (2) of this section and except the money as has\nbeen credited to the account of this state in the unemploy ment trust fund under the\nprovisions of Section 903 of the Social Security Act as amended, and appropriated\nby legislative action authorized thereunder for administrative expenses, money shall\nbe requisitioned from the state's account in the unemployment t rust fund solely for\nthe payment of benefits and in accordance with regulations prescribed by the\nsecretary. The secretary, through the State Treasurer acting as his fiscal agent, shall\nfrom time to time requisition from the unemployment trust fund the amo unts not\nexceeding the amounts standing to this state's accounts therein, as he considers\nnecessary for the payment of benefits for a reasonable future period.\n(2) The Governor may, at any time, pursuant to Section 1202 of the Social Security\nAct, request that funds be transferred from this state's account in the unemployment\ntrust fund for repayment of part or all of that balance of advances made to the state\nunder Section 1201 of the Social Security Act.\n(3) Upon receipt thereof the Treasurer shall deposi t the money in the benefit account\nand shall issue his vouchers for the payment of benefits solely from the benefit\naccount. Expenditures of the money in the benefit account shall not be subject to\nany provisions of law requiring specific appropriations or  other formal release by\nstate officers of money in their custody. All vouchers issued by the Treasurer for the\npayment of benefits and refunds shall bear the signature of the Treasurer and the\napproval in writing of the secretary of the Finance and Administration Cabinet.\n(4) Any balance of money requisitioned from the unemployment trust fund that remains\nunclaimed or unpaid in the benefit account after the expiration of the period for\nwhich the sums were requisitioned shall either be deducted from estimat es for, and\nmay be utilized for the payment of benefits during succeeding periods, or, in the\ndiscretion of the secretary, shall be redeposited with the secretary of the federal\nTreasury to the credit of this state's account in the unemployment trust fund,  as\nprovided in KRS 341.500.\n(5) Notwithstanding the provisions of subsection (1) of this section to the contrary,\nmoney credited to the state under Section 903 of the Social Security Act, as\namended with respect to federal fiscal years 1999, 2000, and 200 1, shall be used\nsolely for the administration of the unemployment insurance program and not\nsubject to appropriation by the General Assembly.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32313","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"5f2413a6de703fc8818968fe7e9d8daf3233c979134768fc66ea7d802cf86c7b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.500","next":"us-ky/krs-341.520"},"notice":"GroundRules: Original legal text.
