{"data":{"id":"us-ky/krs-341.550","jurisdiction":"us-ky","citation":"KRS 341.550","heading":"Pooled account for contributing employers.","body":"(1) The cabinet shall maintain a pooled account for contributing employers to which\nshall be credited:\n(a) Payments received from the federal government under the provisions of\nSection 204(a)(1) of the \"Federal -State Extended Unemployment\nCompensation Act of 1970,\" and amendments thereto;\n(b) All realized earnings and gains on investments of the fund;\n(c) Except as provided in KRS 341.540, any balance remaining in the reserve\naccount of any previously subject contributing employer after such employer\nhas ceased to be subject to this chapter;\n(d) Any payments into or amounts in the fund not allocable to any employer's\nreserve account; and\n(e) Any payments collected under subsection (2) of this section.\n(2) (a) Except as provided in KRS 341.530(4), any benefits pa id through error which\nwould otherwise have been chargeable to the reserve account of a contributory\nemployer shall be charged against the pooled account. However, no employer\nmaking payments to the fund in lieu of contributions shall be relieved of\ncharges by reason of this subsection.\n(b) The repayment of benefits paid erroneously as provided in subsection (1) of\nKRS 341.415 shall be credited to the pooled account. The pooled account\nshall be credited with any sums deducted from future benefits as provide d in\nKRS 341.415 and shall be credited to the pooled account, provided the\nbenefits were charged to the pooled account by reason of KRS 341.530(3), or\nparagraph (a) of this subsection. Except as provided in KRS 341.415(1), if the\nbenefits were charged to a nd paid by any employer making payments to the\nfund in lieu of contributions, the amount of the repayment or the sum\ndeducted from future benefits shall be credited to the reimbursing account of\nthat employer, and may upon written request from the employer  be refunded\nwithout interest.\n(3) One-half (1/2) of the benefits paid to an eligible worker in accordance with KRS\n341.700 to 341.740 shall be charged against the pooled account, except that during\na period in which federal payments to states under Sectio n 204 of the Federal -State\nExtended Unemployment Compensation Act of 1970 are reduced under an order\nissued under Section 252 of the Balanced Budget and Emergency Deficit Control\nAct of 1985 (Public Law 99 -177), one-half (1/2) of the benefits paid to an el igible\nworker in accordance with KRS 341.700 to 341.740, reduced by an amount equal to\nthe difference of one -half (1/2) of the benefits paid to an eligible worker in\naccordance with KRS 341.700 to 341.740 and the amount of the federal payment,\nshall be charged against the pooled account.","path":["KRS Chapter 341"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42087","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:29Z","sha256":"f4b149ca9f3e3a9cb487cc7e907f18195b6d52aa00d3cffc86e32bdfd0a7232e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-341.540","next":"us-ky/krs-341.560"},"notice":"GroundRules: Original legal text.
