{"data":{"id":"us-ky/krs-342.1222","jurisdiction":"us-ky","citation":"KRS 342.1222","heading":"Refunds or credits on canceled or returned premiums.","body":"(1) Every insurance carrier shall be entitled to a refund or credited with assessments\npaid on all canceled or returned premiums, including dividends paid or credited to\npolicyholders, if the assessments are returned by the insurance carrier to the\npolicyholder in addition to the canceled or returned premium.\n(2) The assessments paid pursuant to the provisions of this chapter shall be refunded or\ncredited in the manner provided in KRS 134.580, provided that the claim for refund\nor credit, with respect to all cl aims filed on or after July 13, 1990, is made by the\ninsurance carrier within four (4) years of the date the insurance carrier returns the\nassessments to the employer.\n(3) A claim for refund or credit shall be made on a form prescribed by the funding\ncommission and shall contain any information that the funding commission may\nrequire.\n(4) No insurance carrier shall be entitled to a refund or credit of the assessments paid\npursuant to the provisions of this chapter where the assessments have been collected\nfrom an employer as provided by KRS 342.122, unless the amount of assessments\ncollected from the employer are refunded to him by the insurance carrier who paid\nthe assessments to the funding commission.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32406","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:30Z","sha256":"2b7b856ec9bdf55d501e939df4d1f85a7a43cf819a53decfc20d6054ab043a72","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.1221","next":"us-ky/krs-342.1223"},"notice":"GroundRules: Original legal text.
