{"data":{"id":"us-ky/krs-342.165","jurisdiction":"us-ky","citation":"KRS 342.165","heading":"Increase or decrease in compensation for failure to comply with safety law","body":"-- Compensation not payable if employee falsely represents physical condition\nor medical history at time of employment.\n(1) If an accident is caused in any degree by the intent ional failure of the employer to\ncomply with any specific statute or lawful administrative regulation made\nthereunder, communicated to the employer and relative to installation or\nmaintenance of safety appliances or methods, the compensation for which the\nemployer would otherwise have been liable under this chapter shall be increased\nthirty percent (30%) in the amount of each payment. If an accident is caused in any\ndegree by the intentional failure of the employee to use any safety appliance\nfurnished by t he employer or to obey any lawful and reasonable order or\nadministrative regulation of the commissioner or the employer for the safety of\nemployees or the public, the compensation for which the employer would otherwise\nhave been liable under this chapter s hall be decreased fifteen percent (15%) in the\namount of each payment.\n(2) No compensation shall be payable for work -related injuries if the employee at the\ntime of entering the employment of the employer by whom compensation would\notherwise be payable fal sely represents, in writing, his or her physical condition or\nmedical history, if all of the following factors are present:\n(a) The employee has knowingly and willfully made a false representation as to\nhis or her physical condition or medical history;\n(b) The employer has relied upon the false representation, and this reliance was a\nsubstantial factor in the hiring; and\n(c) There is a causal connection between the false representation and the injury\nfor which compensation has been claimed.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32429","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:31Z","sha256":"ecd0a96e40f76d1bdce80133aedb99b53ebfc103ad85127519f5744de7dd4471","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.160","next":"us-ky/krs-342.170"},"notice":"GroundRules: Original legal text.
