{"data":{"id":"us-ky/krs-342.205","jurisdiction":"us-ky","citation":"KRS 342.205","heading":"Right of employer to require continued physical examination -- Payment of","body":"cost of examination -- Effect of employee's refusal -- Statement of earnings to\nbe furnished at request of party.\n(1) After an injury and so long as compensation is claimed, the  employee, if requested\nby a party or by the administrative law judge, shall submit himself or herself to\nexamination, at a reasonable time and place, to a duly -qualified physician or\nsurgeon designated and paid by the requesting party. The employee shall have the\nright to have a duly -qualified physician or surgeon designated and paid by himself\nor herself present at the examination, but this right shall not deny the requesting\nparty's physician or surgeon the right to examine the injured employee at all\nreasonable times and under all reasonable conditions.\n(2) The party requesting an examination pursuant to subsection (1) of this section shall\nmake arrangements to provide all the cost of the examination. The requesting party\nshall also prepay the cost of tr ansportation of the employee to and from the\nexamination if public transportation is utilized. If the employee uses his or her own\nvehicle to travel to and from the examination, the requesting party shall prepay the\nemployee at the state mileage rate. The requesting party shall also reimburse the\nemployee for the cost of meals, lodging, parking, and toll charges upon proof of\nsame by written voucher. The amounts prepaid or reimbursed by the requesting\nparty, as required by this subsection, shall be the same  as, and in accordance with,\nstate travel administrative regulations and standards promulgated and established\npursuant to KRS Chapter 45.\n(3) If an employee refuses to submit himself or herself to or in any way obstructs the\nexamination, his or her right to take or prosecute any proceedings under this chapter\nshall be suspended until the refusal or obstruction ceases. No compensation shall be\npayable for the period during which the refusal or obstruction continues.\n(4) Any employee receiving benefits under  this chapter may be required, upon request\nof any party, to furnish a sworn affirmed statement of earnings and other supporting\ninformation the administrative law judge may require.\n(5) The cabinet shall supply forms for the report.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32439","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:31Z","sha256":"7f4600bd75aea440136450240bfdd41232bda019281ec249a8ef3e3572d6cab4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.200","next":"us-ky/krs-342.210"},"notice":"GroundRules: Original legal text.
