{"data":{"id":"us-ky/krs-342.260","jurisdiction":"us-ky","citation":"KRS 342.260","heading":"Permitted and required departmental administrative regulations --","body":"Adoption of life expectancy tables -- Processes and procedure -- Subpoenas --\nDuties of sheriff and Circuit Court.\n(1) The commissioner shall promulgate administrative regulations as he  or she\nconsiders necessary to carry on the work of the department and the work of the\nadministrative law judges and may promulgate administrative regulations not\ninconsistent with this chapter and KRS Chapter 13A for carrying out the provisions\nof this chapter.\n(2) The commissioner shall promulgate administrative regulations on or before\nDecember 31, 2015, establishing the information necessary to be received to create\nan e-mail notification system where a person may enter his or her e -mail address\ninto th e Insurance Coverage Look -up database established by the Department of\nWorkers' Claims and be notified of any cancellation of a specific business' workers'\ncompensation coverage.\n(3) The commissioner shall develop or adopt life expectancy tables for use in  making\ncomputations for the apportionment of benefits under KRS 342.120, computation of\nattorneys' fees under KRS 342.320, and for use in all other situations arising under\nthis chapter in which the calculation of a life expectancy is necessary or desirab le,\nincluding the computation of assessments or reserves for self -insurers. The\ncommissioner may adopt life tables published by the United States Department of\nHealth and Human Services or other life tables developed by a qualified entity, as\ndetermined by  the commissioner. The life tables developed or adopted by the\ncommissioner through the promulgation of administrative regulations in effect as of\nthe date of an opinion, award, or settlement approved by an administrative law\njudge shall apply to computations concerning that opinion, award, or settlement.\n(4) Processes and procedures under this chapter shall be as summary and simple as\nreasonably possible. The board or any member thereof or any administrative law\njudge for the purpose of this chapter, may s ubpoena witnesses, administer or cause\nto have administered oaths, and examine or cause to have examined those parts of\nthe books and records of the parties to a proceeding as relate to questions in dispute.\n(5) The sheriff shall serve all subpoenas of the board and administrative law judges and\nshall receive the same fee as provided by law for like service in civil actions. Each\nwitness who appears in obedience to the subpoena of the board or any\nadministrative law judge shall receive for attendance the fe es and mileage for\nwitnesses in civil cases in the Circuit Courts.\n(6) The Circuit Court shall, on application of the board, any member thereof, or any\nadministrative law judge, enforce by proper proceedings the attendance and\ntestimony of witnesses and th e production and examination of books, papers, and\nrecords.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43317","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:31Z","sha256":"c515376d5496b96437da07cf65a1015f316820099b0e373a0ca8999c998aea59","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.255","next":"us-ky/krs-342.262"},"notice":"GroundRules: Original legal text.
