{"data":{"id":"us-ky/krs-342.262","jurisdiction":"us-ky","citation":"KRS 342.262","heading":"Legislative findings -- Commissioner to give recommendation on new","body":"edition of \"Guides to the Evaluation of Permanent Impairment\" -- Approval\nof General Assembly required to effectuate.\n(1) The General Assembly hereby declares it to be the policy of th e Commonwealth of\nKentucky that the most recent and valid scientific and technological advancements\nin medicine be considered in evaluating the nature and extent of an injured worker's\nimpairment.\n(2) (a) Therefore, within one hundred eighty (180) days of publication by the\nAmerican Medical Association of a new edition of the \"Guides to the\nEvaluation of Permanent Impairment,\" the commissioner shall recommend to\nthe General Assembly whether all or a portion of the new edition should be\nenacted by the Genera l Assembly in order to produce more equitable and\naccurate ratings of permanent impairment resulting from work-related injuries.\n(b) Prior to making the recommendation required in paragraph (a) of this\nsubsection, the commissioner shall:\n1. Consult with me dical providers, representatives of injured workers,\nemployers and representatives of employers, insurance carriers, and\nlegal representatives of employers and injured workers; and\n2. Consider studies and analyses conducted by workers' compensation\nrating organizations, including the National Council on Compensation\nInsurance (NCCI).\n(3) The recommendation of the commissioner shall not become effective unless the\nGeneral Assembly approves and adopts the recommendation.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32456","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:31Z","sha256":"bae848bf2ec6372a4db37b80e75336f6483516629ac56b4e5d87440fd40dc1a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.260","next":"us-ky/krs-342.265"},"notice":"GroundRules: Original legal text.
