{"data":{"id":"us-ky/krs-342.310","jurisdiction":"us-ky","citation":"KRS 342.310","heading":"Assessment of cost of unreasonable proceedings -- Restitution.","body":"(1) If any administrative law judge, the board, or any court before whom any\nproceedings are brought under this chapter determines that such proceedings have\nbeen brought, prosecuted, or defended without reasonable ground, he or it may\nassess the whole cost of the proceedings which shall include actual expenses but not\nbe limited to the following: court costs, travel expenses, deposition costs, physician\nexpenses for attendance fees at depositions, attorney fees, and all other out -of-\npocket expenses upon the party who has so brought, prosecuted, or defended them.\n(2) If any administrative law judge, the board, or any court before whom any\nproceedings are brought under this chapter determines that a party has committed\nacts in violation of KRS 342.335(1) or (2), that party may be ordered to make\nrestitution for any compensation paid as a result of the commission of such acts.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32470","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:31Z","sha256":"8b59302887bb6fe1dc16840353c9f20c22da861d3b037e212e200898b2083f36","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.305","next":"us-ky/krs-342.315"},"notice":"GroundRules: Original legal text.
