{"data":{"id":"us-ky/krs-342.352","jurisdiction":"us-ky","citation":"KRS 342.352","heading":"Voluntary programs for integrated management of employer's worker","body":"compensation and group health insurance claims -- Twenty-four hour\ncoverage.\n(1) The commissioner may establish one (1) or more programs for interested employers\nof integrated management of an employer's workers' compensation and group health\ninsurance claims by an insurer authorized to do business in the Commonwealth and\nmay promulgate any administrative regulations necessary to implement the\nprovisions of this subsection. The integrated management of such claims shall in no\nevent affect any benefits, rights, or coverage established pursuant to a workers'\ncompensation insurance policy. Treatment for work -related conditions shall not be\nsubject to either copayments or deductibles. The com missioner shall make a report\ncomparing the results of each program to the expected results under traditional\nworkers' compensation insurance and traditional workers' compensation with a\nmanaged care program. The program shall serve as a tentative model fo r future\nexperiments.\n(2) No policy for twenty -four (24) hour coverage shall become effective until it is\nreviewed and approved by the commissioner, in consultation with the commissioner\nof the Department of Insurance.\n(3) The purchase of a twenty -four (24 ) hour health policy shall not constitute an\nexemption from statutory provisions which require other nonmedical insurance\ncoverage. However, an insurance carrier shall reduce its premium for insurance\ncoverage written without the medical or health care com ponent. Notwithstanding\nthe provisions of Subtitle 13 of KRS Chapter 304, the premium reduction required\nin this subsection shall be subject to the approval of the commissioner of the\nDepartment of Insurance.\n(4) If an employer obtains a twenty -four (24) hour health insurance policy, pursuant to\nthis section, to secure payment of compensation for medical care and treatment\nunder this chapter, the employer shall also procure an insurance policy which shall\nprovide indemnity benefits to ensure that the total coverage afforded by both the\ntwenty-four (24) hour insurance policy and the policy providing indemnity benefits\nshall provide the total compensation required by this chapter.\n(5) The participants in a project for twenty-four (24) hour health coverage shall comply\nwith periodic reporting requirements of the commission.\n(6) Each agency of state government shall cooperate with the commissioner if\nrequested to provide information for the purposes of this section.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32485","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:31Z","sha256":"c44fee35cc1ff04c569e3a04e777d5bed1f1355d3c0b735d610361230be1518d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.350","next":"us-ky/krs-342.355"},"notice":"GroundRules: Original legal text.
