{"data":{"id":"us-ky/krs-342.740","jurisdiction":"us-ky","citation":"KRS 342.740","heading":"Determination of average weekly wage  -- Adjustment  in weekly","body":"maximum  and minimum  income benefits for disability.\n(1) For the purposes of this chapter, the average weekly wage of the state shall be\ndetermined by the commissioner as follows: On or before September 1 of each\nyear, the total wages  reported by subject employers under the Kentucky\nUnemployment  Insurance Law for the preceding calendar year shall be divided\nby the average monthly number of insured workers (determined by dividing the\ntotal number of insured workers reported for the preceding year by twelve (12).\nThe  average annual wage  thus obtained shall be divided by 52 and the\naverage  weekly wage  thus determined rounded to the nearest cent. This\naverage weekly wage shall be certified to the commissioner by the Education\nand  Labor  Cabinet in a  manner  prescribed by  the commissioner by\nadministrative regulation. The average weekly wage as so determined shall be\napplicable for the full period during which income or death benefits are\npayable, when the date of occurrence of injury or of disablement in the case of\ndisease, or of death, falls within the calendar year commencing  January 1\nfollowing the September 1 determination.\n(2) Whenever  a change in the average weekly wage of the state is of an amount\nthat increases or decreases the minimum  weekly income benefits for total\ndisability or death by $1 or more, or the maximum  weekly income benefits for\ntotal disability or for death by $2 or more, computed in each case and rounded\nto the nearest dollar, an adjustment in those minimums or maximums  which are\naffected in the requisite amount by the change in the average weekly wage of\nthe state shall be made  which will reflect the increase or decrease, but no\nchange in these limitations shall otherwise be made.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52472","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:32Z","sha256":"88cc9b0b2fc7d99cf2553ebe0d0d8de3a72cfdf09faf1f66e000c63a8e8cca8a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.735","next":"us-ky/krs-342.750"},"notice":"GroundRules: Original legal text.
