{"data":{"id":"us-ky/krs-342.760","jurisdiction":"us-ky","citation":"KRS 342.760","heading":"Uninsured employers' fund.","body":"(1) There is hereby authorized in the Education and Labor Cabinet an uninsured\nemployers' fund for the purpose of making payments in accordance with the\nprovisions of subsection (4) of this section. The secretary of the Education and\nLabor Cabinet shall be the custodian of the fund, and all moneys and securities\nin the fund shall be held in trust by the secretary of the Education and Labor\nCabinet and shall not be considered a part of the general funds of the state.\n(2) The  secretary of the Education and Labor Cabinet is authorized to disburse\nmoneys  from the fund only upon written order of the administrative law judge or\nthe board.\n(3) All amounts collected as fines and penalties under this chapter shall be paid\ninto the uninsured employers' fund.\n(4) The  uninsured employers' fund shall be responsible for the payment  of\ncompensation when there has been default in the payment of compensation\ndue  to the failure of an employer to secure payment of compensation as\nprovided by this chapter. Such employer shall be liable for payment into the\nfund of all the amounts authorized to be paid therefrom under the authority of\nthis subsection including reimbursement of the special fund of all liability\napportioned to it and for the purposes of enforcing this liability the Education\nand Labor Cabinet, for the benefit of the fund, shall be subrogated to all the\nrights of the person receiving such compensation from the fund. This provision\nshall apply to all pending claims upon which a final order has not been entered.\n(5) In furtherance of this purpose, the Attorney General shall appoint a member  or\nmembers  of his or her staff or special counsel to represent the fund in all\nproceedings brought to enforce claims against or on behalf of the fund.\nNecessary expenses for this purpose including salaries of said staff or special\ncounsel shall be borne by the fund. The Education and Labor Cabinet shall be\nresponsible for the administration of the uninsured employers' fund and shall\nbe charged with the conservation of the assets of the fund.\n(6) On  December 29, 1987, the liabilities of the uninsured employers' fund and its\nassets remaining in the State Treasury shall be transferred to the uninsured\nemployers' fund created within the Education and Labor Cabinet pursuant to\nthis section.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52473","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:32Z","sha256":"aebafedfb6a6985e080ebd81fe1e32f06fd3f9b0c06853e0b0c7759db8910a2e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.750","next":"us-ky/krs-342.765"},"notice":"GroundRules: Original legal text.
