{"data":{"id":"us-ky/krs-342.770","jurisdiction":"us-ky","citation":"KRS 342.770","heading":"Determination of employer's compliance -- Recording certificate","body":"constituting a lien in favor of uninsured employer's fund.\n(1) Upon the filing of a claim the commissioner shall ascertain whether the employer,\nor any other person against whom a claim i s filed and who is not exempt by KRS\n342.630 or 342.650, has secured payment of compensation by either securing\ninsurance coverage or qualifying as a self -insurer pursuant to KRS 342.340. Upon\ndetermination that any employer under this chapter has failed t o comply with the\nprovisions of KRS 342.340, the commissioner shall record, as provided by\nsubsection (2) of this section, a certificate prepared and furnished him or her by the\ngeneral counsel showing the date on which such claim was filed, the date of th e\ninjury alleged, the name and last known address of the employer against whom it\nwas filed, and the fact that the employer has not secured the payment of\ncompensation as required. Upon recordation, such certificate constitutes a valid lien\nagainst the assets of the employer in favor of the uninsured employers' fund for the\nwhole amount which may be due as compensation. Such lien shall be superior to the\nlien of any mortgage or other encumbrance thereafter created and shall continue for\nten (10) years from the time of such recording, unless sooner released or otherwise\ndischarged. A copy of such certificate shall be served upon the employer by the\ncommissioner.\n(2) The certificate constituting a lien in favor of the uninsured employers' fund shall be\nfiled in the following offices:\n(a) The office of the county clerk of the county in which the defendant employer\nresides.\n(b) The office of the county clerk of the county in which the defendant employer\nhas its principal place of business.\n(c) The office of the c ounty clerk in the counties where such employer's property\nis located.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32553","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:32Z","sha256":"34bda880ca7dab652cbadb4ed14511f0ce38a7c410bebb97a9c622842eea8a75","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.765","next":"us-ky/krs-342.780"},"notice":"GroundRules: Original legal text.
