{"data":{"id":"us-ky/krs-342.813","jurisdiction":"us-ky","citation":"KRS 342.813","heading":"Manager -- Qualifications -- Powers and duties -- Bond.","body":"(1) Following a nationwide search, the board shall hire a manager, subject to Senate\nconfirmation in accordance with KRS 11.160 who shall serve at the pleasure of the\nboard. The manager shall be compensated at a level determined by the board.\n(2) The manager shall have proven successful experience for a period of at least five (5)\nyears as an executive at the general management level in insurance operations or in\nthe management of a state fund for workers' compensation.\n(3) The manager shall conduct the day -to-day operations of the authority for the\npurpose of carrying out the policies and procedures of the board. The duties of the\nmanager include, but are not limited to:\n(a) Administering all operations of the authority in accordance with the direction\nof the board;\n(b) Recommending to the board an annual administrative budget covering the\noperations of the authority and, upon approval, submitting the administrative\nbudget, financial status, and actuarial condition of the authority to the\nGovernor and the General Assembly for their examination;\n(c) Directing and controlling all expenditures of the approved budget;\n(d) From time to time, upon the recommendation of an actuary, recommending to\nthe board actuarially-sound rating plans, and the amount of dividends, if  any,\nto be returned to policyholders;\n(e) Investing the assets of the authority under the guidance of the board and in\naccordance with the provisions of Subtitle 7 of KRS Chapter 304;\n(f) Recommending to the board and administering a system of personnel\nadministration;\n(g) Preparing and administering fiscal, payroll, accounting, data processing, and\nprocurement procedures for the operation of the authority;\n(h) Recommending to the board bylaws and uniform procedures for the\nmanagement of the authority;\n(i) Within the limitations of the budget, employing necessary staff personnel in\naccordance with the personnel policies of the board;\n(j) Maintaining appropriate levels of property, casualty, and liability insurance as\napproved by the board to protect directo rs, officers, employees, and assets of\nthe authority; and\n(k) Contracting in accordance with KRS 342.811 for claims administration, safety\nservices, legal defense, actuaries, medical providers, financial services, and\nother services which the manager elects to obtain outside employed staff.\n(4) The manager may:\n(a) Reinsure any risk or part of any risk;\n(b) Cause to be inspected and audited the payrolls of policyholders or employers\napplying to the authority for insurance;\n(c) Establish procedures for adjusting claims in accordance with this chapter; and\n(d) Require policyholders to maintain an adequate deposit to provide security for\nperiods of coverage for which premiums have not been paid.\n(5) The manager shall give an official bond in an amount and with sureties approved by\nthe board. The premium for the bond shall be paid by the authority.\n(6) The provisions of KRS Chapters 18A and 64 shall not apply to the board, the\nmanager, or the staff of the authority; however, the boar d shall adopt a system of\npersonnel administration that includes benefits, grievance procedures, training and\ncompensation.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32566","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:32Z","sha256":"270acd508c12e7629d8f70628e5b01e47772e769be129012949b20ba7658d88e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.811","next":"us-ky/krs-342.815"},"notice":"GroundRules: Original legal text.
