{"data":{"id":"us-ky/krs-342.839","jurisdiction":"us-ky","citation":"KRS 342.839","heading":"Applicability of specified provisions of law.","body":"(1) Notwithstanding any provision of KRS Chapter 304 to the contrary, the authority\nshall be exempt from participation, and shall not join, contribute financially to, nor\nbe entitled to the protection of, any plan, pool, association, guarantee, or insolvency\nfund authorized or required by KRS Chapter 304.\n(2) Except as provided in subsection (1) of this section, the authority shall be subject to\nthe same assessments applicable to workers' compensation premiums as domestic\nmutual insurance companies licensed to do business in the Commonwealth and\ngoverned by the provisions of Subtitle 24 of KRS Chapter 304.\n(3) Notwithstanding the provisions of Subtitle 24 of KRS Chapter 304 or any other\nprovisions of the Kentucky Revised Statutes to the contrary, the minimum num ber\nof directors and procedures required for incorporating a mutual insurance company,\nrequirements relating to the name of a mutual insurance company, and any licensing\nrequirements applicable to mutual insurance companies shall not apply to the\nauthority.\n(4) The authority shall be considered an insurer for purposes of KRS 342.122 and other\nprovisions of this chapter.\n(5) Notwithstanding any provision of KRS Chapter 304 to the contrary the authority\nshall not be subject to the provisions of Subtitle 33 or  other provisions of KRS\nChapter 304 that relate to the liquidation, rehabilitation, dissolution, or sale of any\ninsurance company.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32579","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:32Z","sha256":"31fc4948a71408cdd2912d38a89ac56ce15c5b42e32fefa12984ab17cc6ea070","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.837","next":"us-ky/krs-342.841"},"notice":"GroundRules: Original legal text.
