{"data":{"id":"us-ky/krs-342.843","jurisdiction":"us-ky","citation":"KRS 342.843","heading":"Monitoring of operations of authority by Attorney General and Auditor of","body":"Public Accounts -- Report to General Assembly.\n(1) The Attorney General and the Auditor of Public Accounts shall monitor the\noperations of the authority.\n(2) Either the Attorney General or the Auditor of Public Accounts, or both, may make\nat any time any examinations or investigations, jointly or severally, of the\noperations, practices, management, or other matters relating to the authority as they\ndeem necessary. Either of them s hall have the power to subpoena witnesses and\nrecords for these purposes, and otherwise to compel the giving of evidence for any\nmatter under study. The Attorney General, the Auditor of Public Accounts, or any\nemployee authorized by either of them may requ ire the giving of this evidence\nunder oath and may administer the oath. Any person voluntarily providing\ninformation or evidence may be required to do so under oath administered by the\nAttorney General, the Auditor of Public Accounts, or any employee autho rized by\neither of them. If any person fails or refuses to testify or furnish documentary\nevidence concerning any matter requested, the Franklin Circuit Court, on\napplication of either the Attorney General or the Auditor of Public Accounts or\nboth, may com pel obedience by proceedings for contempt as in the case of\ndisobedience of a subpoena issued from the Circuit Court or of a refusal to testify in\nthe Circuit Court.\n(3) The Attorney General and the Auditor of Public Accounts shall have without\nrestriction:\n(a) Full access to all records of the authority, except that confidential medical\nrecords of employees of insureds are available only by subpoena;\n(b) Full access to all financial transactions and investigations of the authority; and\n(c) The right to attend all meetings of the board and its committees.\n(4) If fraud, mismanagement, illegal activity, imprudent practices, or other deficiencies\nare found in the operations or other practices of the authority, the Attorney General\nor Auditor of Public Accounts, or both shall:\n(a) Recommend internal corrective action;\n(b) Institute a civil action or action for injunctive relief to compel corrective\naction;\n(c) Institute criminal proceedings against any officer or employee of the authority\nor any other person, as defined in KRS 446.010, as may be necessary; or\n(d) Any combination of the above listed actions or any other form of action\nreasonably calculated to assure efficient and honest operations of the authority\nand those involved with it.\n(5) The Attorney General and the Auditor of Public Accounts shall report jointly to the\nGeneral Assembly in January of each year in which the General Assembly convenes\nin an even -numbered-year regular session the results of the monitoring activities\nrequired by this section.","path":["KRS Chapter 342"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32581","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:32Z","sha256":"a42a6007e7603d2c07df237ccd6577d692d3e713cc48a4b113a3fb0edafe7eaa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.841","next":"us-ky/krs-342.900"},"notice":"GroundRules: Original legal text.
