{"data":{"id":"us-ky/krs-343.010","jurisdiction":"us-ky","citation":"KRS 343.010","heading":"Definitions for chapter.","body":"As used in this chapter unless the context requires otherwise:\n(1) \"Apprentice\" means a worker at least sixteen (16) years of age, except where a\nhigher minimum  age standard is otherwise fixed by law, who is employed to\nlearn an apprenticeable occupation as provided in 29 C.F.R. pt. 29;\n(2) \"Apprenticeship agreement\" means  a written agreement, complying with 29\nC.F.R. pt. 29 between an apprentice and either the apprentice's program\nsponsor, or an apprenticeship committee acting as agent for the program\nsponsors, which contains the terms and conditions of the employment and\ntraining of the apprentice;\n(3) \"Commissioner\"  means  commissioner of the Department  of Workforce\nDevelopment, under the direction and supervision of the secretary of the\nEducation and Labor Cabinet, or any person authorized to act in his or her\nbehalf;\n(4) \"Council\" means the Kentucky Apprenticeship Council, which provides advice\nand  guidance to the Kentucky Education and Labor Cabinet regarding the\nCommonwealth's  apprenticeship program;\n(5) \"Supervisor\" means supervisor of apprenticeship;\n(6) \"Trainee\" means a person at least sixteen (16) years of age who has entered\ninto an on-the-job training agreement with an employer or an association of\nemployers or an organization of employees in a construction occupation under\na program which has been approved by a federal agency as promoting equal\nemployment opportunity in conjunction with federal-aid construction projects;\n(7) \"Apprenticeship program\" means a plan containing all terms and conditions for\nthe  qualification, recruitment, selection, employment,  and  training of\napprentices as required under 29 C.F.R. pts. 29 and 30, including such matters\nas the requirement for a written apprenticeship agreement;\n(8) \"On-the-job training program\" means a plan containing all terms and conditions\nfor the qualification, recruitment, selection, employment, and training of a\ntrainee, including such matters as the requirement for a written on-the-job\ntraining agreement other than an apprenticeship program; provided, however,\nthat said program has been approved by a federal agency as promoting equal\nemployment opportunity in conjunction with federal-aid construction projects;\n(9) \"Sponsor\" means  any person, association, committee, or organization in\nwhose  name  or title the program is or is to be registered, irrespective of\nwhether such entity is an employer;\n(10) \"Employer\" means  any person or organization employing an apprentice or\ntrainee whether or not such  person or organization is a  party to an\napprenticeship or on-the-job training agreement with the apprentice or trainee;\nand\n(11) \"Related instruction\" means  an organized and systematic form of instruction\ndesigned to provide the apprentice or trainee with knowledge of the theoretical\nand technical subjects related to the apprentice's occupation.","path":["KRS Chapter 343"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52476","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"36af575575b2c81c234fd289a23187577432bc0875ede0352b989d35381f8d8e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-342.990","next":"us-ky/krs-343.020"},"notice":"GroundRules: Original legal text.
