{"data":{"id":"us-ky/krs-344.015","jurisdiction":"us-ky","citation":"KRS 344.015","heading":"Implementation plans for Federal Civil Rights Act, Title VI by state","body":"agencies.\n(1) As used in this section, \"state agency\" means any department or administrative body\nof state government, as defined in KRS 12.010, that is subject to the requirements\nof Title VI of the Federal Civil Rights Act of 1964, 42 U.S.C. secs. 2000d et seq.,\nand regulations promulgated thereunder.\n(2) Each state agency shall:\n(a) Develop a Title VI implementation plan by January 1, 1995. If required by\nTitle VI or regulations promulgated thereunder, the implementation plan shall:\n1. Be developed with the participation of protected beneficiaries; and\n2. Include Title VI implementation plans of any subrecipients of federal\nfunds through the state agency;\n(b) Submit a copy of the im plementation plan to the Auditor of Public Accounts\nand the Human Rights Commission; and\n(c) Submit annual Title VI compliance reports and any implementation plan\nupdates to the Auditor of Public Accounts and the Human Rights Commission\nby July 1, 1995, and each July 1 thereafter.\n(3) The Auditor of Public Accounts shall prepare a report on the actions which state\nagencies are required to take to implement Title VI, and a report summarizing and\nevaluating, relative to the required implementation actions, th e initial state agency\nimplementation plans and including audit findings from the Auditor of Public\nAccounts field reviews. The Auditor of Public Accounts shall transmit the reports to\nthe Governor, the Human Rights Commission, the Legislative Research\nCommission, and each state agency. The Auditor of Public Accounts may prescribe\nthe report format, procedure, and time frame for purposes of complying with this\nsubsection. The prescribed format, procedure, and time frame shall be established\nby administrative regulation pursuant to KRS Chapter 13A.\n(4) In addition to being available from the promulgating state agency, all\nimplementation plans, reports, and updates required by and submitted under\nsubsection (2) of this section shall be available for inspection  and copying under\nKRS 61.870 to 61.884 in the offices of the Auditor of Public Accounts.\n(5) In any annual audit made of a state agency under KRS 43.050, the Auditor of Public\nAccounts shall determine whether the state agency has complied with subsection (2)\nof this section and shall include the determination in the audit report.\n(6) To the extent permitted by federal law or regulation, any increased costs incurred by\na state agency, the Auditor of Public Accounts, or the Human Rights Commission\nunder this section shall be paid from any available federal funds that may be used\nfor implementation of Title VI of the Federal Civil Rights Act of 1964.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32601","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"ef30cbb64c9dc6297362409100265e51c2229a79078eab58e6899444d247c36f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.010","next":"us-ky/krs-344.020"},"notice":"GroundRules: Original legal text.
