{"data":{"id":"us-ky/krs-344.090","jurisdiction":"us-ky","citation":"KRS 344.090","heading":"Religion or national origin, employment discrimination not unlawful in","body":"certain cases.\nNotwithstanding any other provisions of KRS 344.030 to 344.110, it is not an unlawful\npractice for:\n(1) An employer to hire and employ employees, or an employment ag ency to classify,\nor refer for employment an individual, for a labor organization to classify its\nmembership or to classify or refer for employment an individual, or for an\nemployer, labor organization, or joint labor -management committee controlling\napprenticeship or other training or retraining programs to admit or employ an\nindividual in any such program, on the basis of his religion or national origin in\nthose certain instances where religion or national origin is a bona fide occupational\nqualification reasonably necessary to the normal operation of that particular\nbusiness or enterprise.\n(2) A religious corporation, association, or society to employ an individual on the basis\nof his religion to perform work connected with the carrying on by such corpora tion,\nassociation, or society of its religious activity.\n(3) A school, college, university, or other educational institution to hire and employ\nemployees of a particular religion if the school, college, university, or other\neducational institution is, in whole or substantial part, owned, supported, controlled,\nor managed by a particular religion or by a particular religious corporation,\nassociation, or society, or if the curriculum of the school, college, university, or\nother educational institution is dire cted toward the propagation of a particular\nreligion and the choice of employees is calculated by such organization to promote\nthe religious principles for which it is established or maintained.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32611","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"96bc3e04da3fdef2a16ca949abe206bfb51f9aca2b9e88033b7f304856ae7086","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.080","next":"us-ky/krs-344.100"},"notice":"GroundRules: Original legal text.
