{"data":{"id":"us-ky/krs-344.230","jurisdiction":"us-ky","citation":"KRS 344.230","heading":"Orders of commission -- Nature of affirmative action.","body":"(1) If the commission determines that the respondent has not engaged in an unlawful\npractice, the commission shall issue a final order in accordance with the provisions\nof KRS Chapter 13B dismissing the complaint. A copy of the order shall be\ndelivered to the complainant, the respondent, the Attorney General, and any other\npublic officers and persons that the commission deems proper.\n(2) If the commission determines that the respondent has engaged in an unlawful\npractice, the commission shall issue a final orde r requiring the respondent to cease\nand desist from the unlawful practice and to take affirmative action as in the\njudgment of the commission will carry out the purposes of this chapter. A copy of\nthe final order shall be delivered to the respondent, the c omplainant, the Attorney\nGeneral, and to any other public officers and persons that the commission deems\nproper.\n(3) Affirmative action ordered under this section may include, but is not limited to:\n(a) Hiring, reinstatement, or upgrading of employees with  or without back pay.\nInterim earnings or amounts earnable with reasonable diligence by the person\nor persons discriminated against shall operate to reduce the back pay\notherwise allowable.\n(b) Admission or restoration of individuals to union membership, a dmission to or\nparticipation in a guidance program, apprenticeship training program, on -the-\njob training program, or other occupational training or retraining program, and\nthe utilization of objective criteria in the admission of individuals to such\nprograms.\n(c) Admission of individuals to a place of public accommodation, resort, or\namusement.\n(d) The extension to all individuals of the full and equal enjoyment of the\nadvantages, facilities, privileges, and services of the respondent.\n(e) Reporting as to the manner of compliance.\n(f) Posting notices in conspicuous places in the respondent's place of business in\nform prescribed by the commission.\n(g) Sale, exchange, lease, rental, assignment, or sublease of real property to an\nindividual.\n(h) Payment to the complainant of damages for injury caused by an unlawful\npractice including compensation for humiliation and embarrassment, and\nexpense incurred by the complainant in obtaining alternative housing\naccommodations and for other costs actually incurred by the complainant as a\ndirect result of an unlawful practice.\n(4) The commission may publish or cause to be published the names of persons who\nhave been determined to have engaged in an unlawful practice.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32626","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"cebf803b8a3093c249c975638f88f22f81b589f87ee2b118c69010d8dd3f5a83","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.220","next":"us-ky/krs-344.240"},"notice":"GroundRules: Original legal text.
