{"data":{"id":"us-ky/krs-344.240","jurisdiction":"us-ky","citation":"KRS 344.240","heading":"Scope of and procedure for judicial review --Hearing -- Appeal.","body":"(1) Any complainant, respondent, or intervenor aggrieved by a final order of the\ncommission, including a final order dismissing any complaint or stating the terms of\na conciliation agreement, may obtain judicial review, and the commission may\nobtain an order o f the court for enforcement of its final order, in a proceeding\nbrought in the Circuit Court in a county in which the alleged unlawful practice\nwhich is the subject of the final order or complaint occurs or in which a respondent\nresides or has his principal place of business.\n(2) Except for a discriminatory housing practice, if the commission has failed to\nschedule a hearing in accordance with KRS 344.210(1) or has failed to issue a final\norder within one hundred eighty (180) days after the complaint is fil ed, the\ncomplainant, respondent, Attorney General, or an intervenor may petition the\nCircuit Court in a county in which the alleged unlawful practice set forth in the\ncomplaint occurs or in which the petitioner resides or has his principal place of\nbusiness for an order directing the commission to schedule a hearing or to issue its\nfinal order. The court shall follow the procedure set forth in KRS Chapter 13B and\nthis section so far as applicable.\n(3) If before the expiration of sixty (60) days after the da te of the commission order is\nentered for a discriminatory housing practice and no petition for review has been\nfiled under subsection (1) of this section, any person entitled to under the\ndiscriminatory housing practice order may petition for a decree enf orcing the order\nin the Circuit Court for the county in which the discriminatory housing practice is\nalleged to have occurred.\n(4) Except for subsection (2) of this section, all provisions in this section shall apply to\norders issued in a discriminatory housing practice proceeding.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32627","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"3dc885de4b380dd7da040ee90f2ad05e6e60417efdb1f726c7744d925bcbd01b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.230","next":"us-ky/krs-344.250"},"notice":"GroundRules: Original legal text.
