{"data":{"id":"us-ky/krs-344.250","jurisdiction":"us-ky","citation":"KRS 344.250","heading":"Investigations, powers, records, confidential nature of.","body":"(1) In connection with an investigation of a complaint filed under this chapter, the\ncommission or its designated representative at any reasonable time may request\naccess to premises, records, and documents relevant to the complaint and the right\nto examine, photograph and copy evidence.\n(2) Every person subject to this chapter shall (a) make and keep records relevant to the\ndetermination of whether unlawful practices have been or are being committed, (b)\npreserve such records for such periods, and (c) make suc h reports therefrom, as the\ncommission shall prescribe by regulation or order, after public hearing, as\nreasonable, necessary, or appropriate for the enforcement of this chapter or the\nregulations or orders thereunder.\n(3) The commission, by regulation, sh all require each person subject to this chapter\nwhich controls an apprenticeship or other training program to keep all records\nreasonably necessary to carry out the purpose of the chapter, including, but not\nlimited to, a list of applicants who wish to par ticipate in such program, including\nthe chronological order in which applications were received, and shall furnish to the\ncommission upon request, a detailed description of the manner in which persons are\nselected to participate in the apprenticeship or other training programs.\n(4) A person who believes that the application to it of a regulation or order issued under\nthis section would result in undue hardship may apply to the commission for an\nexemption from the application of the regulation or order. If t he commission finds\nthat the application of the regulation or order to the person in question would\nimpose an undue hardship, the commission may grant appropriate relief.\n(5) So as to avoid undue burdens on persons subject to this chapter, records and repo rts\nrequired by the commission under this section shall conform as near as may be to\nsimilar records and reports required by federal law and the laws of other states and\nto customary record-keeping practice.\n(6) It is unlawful for a commissioner or employe e of the commission to make public\nwith respect to a particular person without his consent information obtained by the\ncommission pursuant to its authority under this section except as reasonably\nnecessary to the conduct of a proceeding under this chapter.\n(7) If a person fails to permit access, examination, photographing or copying or fails to\nmake, keep, or preserve records or make reports in accordance with this section, the\nCircuit Court for the county in which such person is found, resides, or has his\nprincipal place of business, upon application of the commission, may issue an order\nrequiring compliance.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32628","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"bcd51fa8029f8eeb9bcffc7ed08836d5ce446c697e6435956e10eac7938e8fa4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.240","next":"us-ky/krs-344.260"},"notice":"GroundRules: Original legal text.
