{"data":{"id":"us-ky/krs-344.365","jurisdiction":"us-ky","citation":"KRS 344.365","heading":"Exemptions from housing provisions.","body":"(1) Nothing in KRS 344.360 shall apply:\n(a) To the rental of a housing accommodation in a building which contains\nhousing accommodations for not more than two (2) families living\nindependently of each other, if the owner or a member of his family resides in\none of the housing accommodations;\n(b) To the rental of one (1) room or one (1) rooming unit in a housing\naccommodation by an individual if he or a member of his family resides\ntherein;\n(c) To a religious organization, association, or society, or any nonprofit institution\nor organization operated, supervised, or controlled by or in conjunction with a\nreligious organization, association, or society, which limits the sale, lease,\nrental, occupancy, assignment, or sublease of a housing accommodation\nwhich it owns or operates for other than commer cial purpose to persons of the\nsame religion, or from giving preference to those persons, unless membership\nin the religion is restricted on account of race, color, or national origin. Nor\nshall anything in this chapter prohibit a private club not in fact open to the\npublic, which as an incident to its primary purpose or purposes provides\nlodgings which it owns or operates for other than a commercial purpose, from\nlimiting the rental or occupancy of the lodgings to its members or from giving\npreference to its members.\n(d) To a private individual homeowner disposing of his property through private\nsale without the aid of any real estate operator, broker, or salesman and\nwithout advertising or public display except that attorneys, escrow agents,\nabstractors, title companies, and other professional assistance may be utilized\nas necessary to perfect or transfer the title.\n(2) Nothing in this chapter shall require a real estate operator to negotiate with any\nindividual who has not shown evidence of financial abili ty to consummate the\npurchase or rental of a housing accommodation.\n(3) Nothing in this chapter shall limit the applicability of any reasonable local, state, or\nfederal restrictions regarding the maximum number of occupants permitted to\noccupy a housing ac commodation. No provision in this chapter regarding familial\nstatus shall apply with respect to \"housing for older persons,\" as defined in the\nFederal Fair Housing Act, 42 U.S.C. 3607.\n(4) Nothing in this section prohibits conduct against a person because the person has\nbeen convicted by any court of competent jurisdiction of the illegal manufacture or\ndistribution of a controlled substance as defined in Section 102 of the Controlled\nSubstances Act (21 U.S.C. 802) or KRS Chapter 218A.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32641","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:33Z","sha256":"cc2fcf0c4ac8ce86b9a6515d2b1d99179dbe104853610e7f334a5cc0494ff6e0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.362","next":"us-ky/krs-344.367"},"notice":"GroundRules: Original legal text.
