{"data":{"id":"us-ky/krs-344.660","jurisdiction":"us-ky","citation":"KRS 344.660","heading":"Damages and injunctive relief available.","body":"(1) In a civil action under KRS 344.650, if the Circuit Court finds that a discriminatory\nhousing practice has occurred or is about to occur, the Circuit Court may award to\nthe plaintiff actual and punitive damages, and subject to subsection (3) of this\nsection, may grant as relief, as the court deems appropriate any permanent or\ntemporary injunction, restraining order, or other order including an order enjoining\nthe defendant from engaging in the practice or ordering affirmative action as\nappropriate.\n(2) In a  civil action under KRS 344.240, 344.650, or 344.665, the court, in its\ndiscretion, may award the prevailing complainant, a reasonable attorneys' fee and\ncosts. The court, in its discretion, may award the prevailing respondent a reasonable\nattorneys' fee and costs if the respondent establishes that the complaint upon which\nthe action was based was brought in bad faith. Whether a party has committed bad\nfaith shall be determined in accordance with Rule 11 of the Kentucky Rules of Civil\nProcedure. The state shall not be liable in any event for fees and costs.\n(3) However, no relief provided under this section shall effect any contract, sale,\nencumbrance, or lease consummated before the granting of that relief, and involving\na bona fide purchaser, encumbrancer, or tenant, without actual notice of the filing of\nthe complaint of a discriminatory housing practice complaint with the commission\nor the filing of a civil action.","path":["KRS Chapter 344"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32672","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"1748fa7673bcb73a250f3677d4bfb18e4f8d7171fcfe9294c9017187001d0c9f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-344.655","next":"us-ky/krs-344.665"},"notice":"GroundRules: Original legal text.
