{"data":{"id":"us-ky/krs-345.050","jurisdiction":"us-ky","citation":"KRS 345.050","heading":"Activities prohibited and duty to bargain in good faith.","body":"(1) Except as provided in KRS  336.130, public employers, their representatives or\ntheir agents are prohibited from:\n(a) Interfering, restraining or coercing firefighters in the exercise of the rights\nguaranteed in KRS 345.030;\n(b) Dominating or interfering with the formation, existence or administration\nof any labor organization;\n(c) Discriminating in regard to hiring or tenure of employment or any term or\ncondition of employment to encourage or discourage membership in any\nlabor organization;\n(d) Discharging or otherwise discriminating against an employee because he\nhas  signed or filed any affidavit, petition or complaint or given any\ninformation or testimony under this chapter;\n(e) Refusing to bargain collectively in good faith with a labor organization\nwhich is the exclusive representative of employees in an appropriate unit,\nincluding but not limited to the discussing of grievances with the exclusive\nrepresentative.\n(2) Labor organizations or their agents are prohibited from:\n(a) Restraining or coercing:\n1. Firefighters in the exercise of the right guaranteed in subsection (1)\nof KRS 345.030, and\n2. A  public employer in the selection of his representative for the\npurposes of collective bargaining or the adjustment of grievances;\n(b) Refusing to bargain collectively in good faith with a public employer, if\nthey have been designated in accordance with the provisions of this\nchapter as the exclusive representative of firefighters in an appropriate\nunit.\n(3) For the purposes of this chapter, to bargain collectively is to carry out in good\nfaith the mutual obligation of the parties, or their representatives; to meet\ntogether at reasonable times, including meetings  in advance  of the\nbudget-making process; to negotiate in good faith with respect to wages, hours\nand other conditions of employment; to negotiate an agreement; to negotiate\nany question arising under any agreement; and to execute a written contract\nincorporating any agreement  reached, if requested by either party.
