{"data":{"id":"us-ky/krs-345.120","jurisdiction":"us-ky","citation":"KRS 345.120","heading":"State Labor Relations Board.","body":"(1) There is hereby created and established a State Labor Relations Board to\nassist in resolving disputes between public employers and firefighters or their\nlabor organization which shall be composed of three (3) members  appointed by\nthe Governor, one (1) for a term of two (2) years, one (1) for a term of three (3)\nyears, and one (1) for a term of four (4) years. The Governor shall designate\none  (1) member  to serve as chairman of the board. Thereafter, upon the\nexpiration of the term of any member, members  shall be appointed for four (4)\nyear terms by the Governor.\n(2) Each member  of the board shall have been an elector in this state for at least\none  (1) year next preceding his or her appointment. Any member  may  be\nremoved  by the Governor for cause, shown  in an administrative hearing\nconducted in accordance with KRS  Chapter 13B. The Governor shall fill any\nvacancy by appointment for the unexpired term. No member  shall receive a\nsalary but each member  shall be paid fifty dollars ($50) and expenses for each\nday during which he or she is engaged in the duties of the board. The board is\nauthorized to hold hearings at any place in this state. Any and all expenses\nincurred by the Labor Relations Board shall be shared by all parties concerned\nin the dispute.\n(3) The  board shall appoint employees necessary to carry out the work of the\nboard. All files, records, and documents accumulated by the board shall be\nkept in offices provided by the board. All decisions shall be made by a majority\nof the board.\n(4) To  accomplish the objectives and to carry out the duties prescribed by this\nchapter, the board may subpoena witnesses; issue subpoenas to require the\nproduction of books, papers, records, and documents which may be needed as\nevidence in any matter under inquiry; and administer oaths and affirmations.\n(5) In case of neglect or refusal to obey a subpoena issued to any person, the\nCircuit Court of the county in which the investigations or the public hearings are\ntaking place, upon application by the board may issue an order requiring the\nperson to appear before the board, any member, or agent, to produce evidence\nor give testimony about the matter under investigation. A failure to obey a court\norder may be punished by the court as a contempt.\n(6) Any subpoena, notice of hearing, or other process or notice of the board issued\nunder the provisions of this chapter, with the exception of notice requirements\nfor administrative hearings as provided in KRS  Chapter 13B, may be served\npersonally, by certified mail, return receipt requested, or by leaving a copy at\nthe principal office or place of residence of the respondent required to be\nserved. A return, made  and verified by the individual making service and\nsetting forth the manner  of service, is proof of service and  a returned\npost-office receipt, when certified mail is used, is proof of service. All process of\nany  court to which application may  be made  under the provisions of this\nchapter may  be served in the county in which the persons required to be\nserved reside or may be found.\n(7) The  board shall, promulgate, amend, or repeal any administrative regulations\nnecessary and administratively feasible to carry out the provisions of this\nchapter. Public hearings shall be held by the board, pursuant to KRS  Chapter\n13A,  on  any  proposed  administrative regulation of general applicability\ndesigned to implement, interpret, or prescribe policy, procedure, or practice\nrequirements under the provisions of this chapter and on any proposed change\nin an existing administrative regulation.\n(8) The  board shall be  attached to the Education and  Labor Cabinet for\nadministrative purposes.","path":["KRS Chapter 345"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52479","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"c6352b549425ae20f6db9a2c8fd3b5cd5f2ef302f2fbd2f290305170e4cb6c78","source_id":"us-ky","stale":false,"prev":"us-ky/krs-345.110","next":"us-ky/krs-345.130"},"notice":"GroundRules: Original legal text.
